The Ex is ruining me!

Hi,
I split from my ex two and a half years ago with the agreement that he stays in the house and pays the mortgage and the secured loan.
He has been paying the mortgage but not the loan and has burried his head in the sand and refusing to answer their calls or letters. He is now married and has a child.
I have spoken to several solicitors and there appears to be nothing or my side to help me out of this situation. He has ruined my credit rating. He ran up debts on the joint account which I paid off, there were other unpaid bills which I have also dealt with. I have asked him to sell the house but he refuses and I have offered to meet up with him so we can find an amicable solution, but its one excuse after another.
I want nothing from the house I just want to be free of him for good.
I was recently advised to make an offer to the loan company in order to protect myself from recovery action that they are planning. I offered them £10 a month, which has been refused. Whilst on the phone to them I went through my income and expenditure and they seem to think from this that I can afford to pay them £200 with the supposed £292 disposable income that I have. Can they make me pay £200 a month?
I do not have this, month by month its a struggle to make ends meet, I do not go out partying or go on shopping trips. My car is falling to bits and I still have an overdraft that I am unable to reduce. I have a debt management plan for my credit cards. I have just received an offer of a part time university payment, but it looks like I don't qualify for any funding or grants so will have to pay for my tuition and books myself as its not a work related degree my employers won't help me out.
As previously mentioned, he is living in the house with his wife and child, they both work and I want nothing financially from the house. I just simply want out and to get him out of my life for good.
Please help.

Can't offer any advice It's an awful situation and I hope you can sort it out. Is your name on the mortgage? If so can he not buy you out?
Good luck. T C MEvery Penny's a Prisoner.

Hi
We ned to know very clearly what joint debts you have or had?
the mortgage
and the secured loan
joint account which I paid off,
there were other unpaid bills
What exactly are the terms of the joint mortgage? If you've have not made a mistake, you've made nothing0 -
Hi Kirsty
I assume that you didn't take any legal action to remove yourself from the property/mortgage or loan?
Does the house have any equity or after the mortgage and the loan is it in negative equity?
I think you probably need legal advice on either getting him to remortgage the property in his own name (or with his wife) or to insist on the house being sold. Not sure what exactly you have discussed with solicitors yet but you cannot be forced to stay as an owner to the house (and on the mortgage) if you do not want to be. Of course if you sell up now (or transfer ownership) and there is negative equity then that debt would still exist and would still need paying (theoretically by you and ex between you, but in reality you would both be liable for the full amount).
You say you have a debt management plan for some other debts, is this something you have negotiated yourself with your creditors or are you using a charity to do this for you? If you are using a commercial company who charge you a fee then you can get the same service for free.
As it stands if the loan is in your name as well as ex's and is a secured debt then it should take priority over any unsecured debts you have. So I can see that they would think £10 was not sufficent if you are paying your unsecured creditors significantly more.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
