need csa advice

my husband has received a letter from csa saying due to change of circumstances he now has to pay £40 per week has just spoken to them on phone they have said they lost the accounts he sent in but have looked at his tax return and he earns £38 per week we asked how supposed to afford £40 they said they have taken all our tax credits into account i thought they could only use working tax as it in his name and i get the child tax credits can anyone help if earnt more than him and had both in my name can they use them i do agree he should have to pay but only just making ends meet at mo anyway

    child tax credits are always taken into account, but working tax are treated as the income of the highest earner, so if u earn more than your partner you need to contact csa and make sure obly the child tax credits have been used. hth

    thanks for your help would that mean i have to call tax credits and get it all put into my name if i work less hours but earn more can i put them into my name

    I don't think it matters whose name it is in as it is a joint claim.
    If you are the higher earner then the WTC are not touched, all the child tax credits will be included

    ok thanks will save me load of calls to tax office expect will take them another year to sort out this mess as they already admittied losing the accounts we sent a year ago which they signed for
