Hi

I have lived with partner for 14 years and we are splitting up because he has met someone else. The mortgage in his name and he had the house 2 years before i moved in. I've paid money directly into his account each month and paid for most of the food bills. The mortgage is small and the house has increased in value 5 times what it was worth when i moved in. I am struggling to work out how much I should ask for (I know legally i'm not entitled to anything). Any suggestions?

    As there is still a mortgage your ex potentially has no money to give (all goes on mortgage), and as you say you have not been on the mortgage/deeds so you have no claim to the house, and your not married so no divorce settlement.
    Harsh for 14 years together, but I think i am right in saying that no matter what you ask for he could refuse and you would struggle to challenge it. I think you should go to one of the free 30 minute solicitor sessions.
    A friend of a friend brought a house and paid the mortgage, but put it all in his partner name. She left and took the house, legal advice was your not married so anything not in your name you can't take. He was left pretty much penniless.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    Where do you live Julie? I live in Scotland and here I believe if you have lived with someone for more than 6 months and can prove it (ie bills in your name, on the electoral register etc) then you are classed as common law partners and are entitled to half of everything. I don't think the same applies in England so I guess this only helps in you are in Scotland..... good luck!!

    I heard about that, but wasn't it scrapped for England. I would be against it been automatic, 6 months really isn't a great deal of time.

    The poster real needs to see a solicitor, maybe try a couple to ensure some good opinions.
