Attachment if Earnings order (Not yet bankrupt)

My partner and I are due to go to court in July to go through Bankruptcy and we have received a Notice of Application for Attachment of Earnings Order.

Where do we stand at this stage in advising them of the fact that we are due to go Bankrupt in the next few months.

Do we complete the forms and return them or do we send letter advising of our intentions

What can they do etc as they have said failure to complete forms can result in us going to prison:eek:

    You need to complete and return - assuming that the AofE relates to a debt which is proven in BR, when you go BR then the OR will write to the court and the AofE should then be cancelled.

    The judge will decide a reasonable amount, usually you will provide an income and expenditure list and usually they will not allow the pay to go below a certain level

    Can they force Bankruptcy (make us do it instead of us having to save up the costs)????

    they could but it is not in their interests as if they get the AOE they get a regular payment each month
