Change of circumstances

My husband is paying for two children which is right. We paid off his arrears and ever since the CSA have not managed to send us a correct schedule.

What they're doing is missing a month and then expecting my husband to pay around £800 which would leave us next to nothing to live on. Its their fault that they're delaying sending the schedule. My husbands next amount is not due to 6/05 but I bet we dont get the schedule in time, bearing in mind I've paid this month on my credit card.

My husband has to inform CSA of any changes but his ex-wife never does. Both his children are at college but they both work part-time should there be an overview. We've tried telling the csa but they say they can only take that information from the ex-wife.

    If child benefit is still getting paid then so will maintenance. Im sure the mother will still get this while children are still at college

    ab2 - the kids can work up to a limit (16 hours I think) per week, while at college.

    karenx - CB is not legally a qualifying benefit for child maintenance payments. While the CSA use it and claim it is - it is not.

    surely your husband can work out how much he is due to pay ie 20% net for 2 kids, if they dont take it one month, put it aside and dont spend it! did your husband complain to them they never took payment one month?

    If you have paid off the arrears though then you know roughly how much you should have to pay?

    Can I suggest that you pay the amount that you think is due rather than wait for a schedule? That will mean that you are at least 90% of the way there rather than having to fall into arrears again.

    Children only have to be at college for 12 hours a week, and can work up to 16 hours and also get EMA, none of this affects your husbands liability, he is still responsible for paying for them whilst they are classed as in full time education. The CSA takes the Child Benefit payment as the proof that they are still in full time education, as the benefit is paid either until their 19th birthday (due to rise to 20 in some cases) or the September following them leaving full time education.
