lloyds tsb bailiffs

Hi all,

Sorry if you already read this but I posted in loans by accident first.
I urgently need some advice on a problem I am having at the moment or to be more specific a debt my husband had with lloyds tsb it was for a credit card that we got in so much trouble with that it is now a ccj we have gone through some really bad times credit wise and life wise and we are on the way to sorting most of our problems but this one is by far the worst the court origionally ordered us to pay £100 per month because we didn't get the forms to them on time we had to apply for a suspension of any warrants and reduction in the order for which we had to pay a thirty pound fee at the same time as this we had another one to sort out with cl finance (mothercare card) so we had to send two fees which I had to borrow from family as although we could not afford it we do not claim any of the benefits listed on the exemption form the fees were sent to Gateshead county court and we got information back from the M'care card one saying payments were accepted and directing who to make payments to which we immediately began paying and as we hadn't heard from the lloyds one we directed the extra money to this debt to try and pay it off quicker we still did not hear from them about the lloyds debt I rang them on several occasions to query this and the people at the court told us that lloyds had not responded to the offer so they were unclear as to their intentions.

That was how it was left until this June when I get a warrant posted through my door from a bailiff based at Newcastle upon tyne county court who are now pursuing the debt on speaking to them and by telling them what has gone on previously they inform me that the first warrant expired which is why nothing happened and demand I put it in writing I did this and I have a copy of the letter I sent them but they did not respond and deny receiving the letter there was supposed to be a man dealing with it at the court and he rang me on my home number and my mobile to speak with me about it told me his name was colin spoke to me and sid he was still working on it but he would get back to me. Never heard another thing they say the debt is with Newcastle now as gateshead do not deal with it anymore.

I have spoken to the bailiff today who told me I must pay another fee which I don't think I should pay as I have already paid once and borrowed the money for that and have not yet been able to repay as I haven't had the spare funds to do so borrowing more for the same thing is out of the question and I don't think I should as what happened to the first one where did that go to as no one has acted on anything that we sent other than cashing our cheque and its rubbish that you pay for a service and then don't receive that service the only proof I have is the cheque number and a date the cheque was cashed and of course a cheque stub along with the fact that we dealt with both at the same time now I spoke to the bailiff this morning who got quite snotty threatened to come to my home I have tried all ways to getit sorted I am 8 weeks pregnant and grieving for my grandmother who died 3 weeks ago I don't need the stress.

After speaking to the bailiff this morning I then went back to the enforcement office to try again to find out what happened to my money ended up speaking to a different bailiff who agreed with me that what is happening to us is wrong but less than a minute after him saying this and promising to investigate I get the other stroppy git on the phone accusing me of going behind his back and trying to talk to other people for different answers.

I have spent the best part of my day trying to sort this out and have got nowhere other than some debt advice people telling me not to let the bailiff in.

The bailiff says that even if I have not received any letters or any correspondance I should have made payments I said I thought this was ridiculous how can you make payments when you don't know what they are he said I did as I made the offer my answer is the same I did not know if they accepted the offer because we never had any correspondance not even from lloyds to say we were in arrears with our payment schedule someone I feel has cocked up big style but no one will help or admit it they are just demandingmoney and fees we dont have and threatening to clear my house out we are making a clear effort to sort this out and we are being treated like criminals.

Can anyone help me ?

Am I right or wrong and what do i do next

    Hi amanda,

    I'm no expert but things do sound very dodgy from their end especially if one of the bailiffs you spoke to agrees with you.

    The only advice I can really give is that every time you write to them keep a copy, and every time you speak to them on the phone make a note of WHO you speak to, the time you spoke to them and what was said.

    Are you able to get back to the "good guy" who agreed with you?

    I personally think the words bailiffs and bullies go together... don't let them get to you, I realise it must be hard and i'm sure i'd be just as upset and worried about it as you but you mustn't let them get the upper hand, stick to your guns and the facts and ride this out, as long as you're honest about it all I can't see what they can do.

    Is it worth speaking to the citizens Advice Bureau? They may be able to suggest some avenues you can take to deal with it, plus if certain bailiffs become accusatory (you're going behind my back speaking to other people etc etc) which is not on...and from the sound of it could become abusive you may have a case against them for something like abusive behaviour, harassment etc, at least the CAB would point you in the right direction and have info such as phone numbers at their finger tips.

    You're pregnant, is the OH around, is he helping with it at all? Are there other family members/friends who can support you through this? Please try and keep calm for all your sakes (baby too!!)

    I'm sure there are lots of others on these forums who will be able to give you much better advice, just hang on in there!! (I would send you some hugs but having trouble inserting smilies!)

    Hi pop,big :grouphug: sorry to hear what you're going through at the moment,you really don't need this stress at 8 weeks pregnant.
    I'm sorry but I have no experience of bailiffs (yet!) so really can't advise you on your best course of action :confused:
    Just wanted to bump you up so you don't get forgotten :D

    something that may be helpful (or not) if you go onto the loans section and look for a thread saying "cancelling PPI CAN BE DONE" go on there and on the first page scroll down and its the 4th message by someone called raven(something) they have a link on their message called boards fool (or something similar)... click on it and scroll down looking at the right hand side block and it mentions how to get your own back and how to deal with them...i haven't clicked on them myself but I saw it and thought of you...

    Your post is slightly confusing. If I have it right you have gone through one CCJ but Lloyds did not respond to your offer.
    Now you have a second CCJ that you knew nothing about at a different court. You should apply to have this judgement set aside as you did not get the paperwork (summons). There will be a new hearing date set and you can ask to have the hearing at a court near you. You should go to this one.
    This process should be started immediately and send copies of the paperwork to the bailifs. They should stop chasing you then, it will definately stop them once the judgement is set aside.

    In the meantime, your problem is that you are firefighting rather than being pro active. You need to contact CCCS and set up a DMP ASAP. You should also start sending all your creditors some token payments whether they accept or not.
