manager not passed sick note on to payroll

My gf has been signed off sick for the last month and a half with stress and depression and sent her sicknote in to her area manager as standard procedure. This payday (end March) she didnt recieve a paysli pin the post, phoned to ask where it was (knowing it'd be lower as only on SSP), was told she wont get one as her manager had failed to pass on her sick note from last month, she'd been overpaid last month, and the money they're taking back leaves her with £0 for this month!!
Is this right? And can they do that? Surely a mistake their end shouldnt penalise my gf and not even send out a payslip?

If your gf suffers a loss as a result of somebody else's mistake then she is entitled to be compensated. She has a duty to keep the loss to a minimum. This is just as true in an employment situation.
If she has been overpaid then, under virtually all circumstances, the employer is entitled to have the money back. However they can only deduct this from her salary with her permission. She may, by means of her contract, have given blanket permission for this. If not, then this is an unlawful deduction of wages which could (in theory) be taken to a tribunal.0 -

1) Payroll obviously need to see evidence of a sick not and they have not so its fair for them to not pay her
2) The manager was wrong to not forward the sick note on
3) They are entitled to the overpayment back but they should have contacted her about it and arranged a suitable repayment plan.
4) Any financial hardship caused by this error (ie bank charges) should mean you are able to claim these back from your employer
5) Ask the branch for a temporary loan to get through the month
Basically her manager has stuffed her good and proper and getting a quick fix may not be that easy, she needs to liase (and not shout at or have a go at) with payroll and see what she can do to get some money and stress the problems this has causedAlways ask ACAS0 -

It is indeed bendix, i'm fortunate to only have just the one gf (2 like this one would probably send me to an early grave lol) We're not sure if it was gross miscouduct yet, but she was escorted off the premises for sending a single text yes, am thinking the 'no payslip for March' is some kind of message from the company perhaps?
