Questions Regarding House

Sorry I think I will be begin to become a pain.

At the moment my house in on the market jointly owned with the Soon To Be Ex Husband.

If I go BR before our divorce if finalised what happens to the house.

Will the OR allow it to stay on the market and just take 50% of the equity?

At the moment I am living there but I am planning at some point to move to rented. Not sure if I should do this now before BR or wait?

What will be the lenders position on this (who are NR) there are also 2 secured loans on the property with them.

Will NR go after ex for payments?

Just really want to know what all the consquences are as OK as much as I dislike the ex don't really want to drop him in it totally (although as those in the know know he not being easy right now!)

Any advice would be helpful!!:)

After the bankruptcy you cannot put it on the market but there is nothing to stop the ex putting it on the market. If he gets a buyer you will need the OR's agreement to sell. Usually as long as the transaction is at "arms length" and for true market value then the OR will be happy to agree and take 50%.

    Thanks guys.

The house is already on the market - but assume I now take a step back and the estate agents deal with the ex.

Would I need to move out immedately?

Should I carry on paying the mortgage?
