SKY TV debt recovery

Hi,
SKY TV have sent a second debt recovery company to get £136 from me from a debt they say is from 2005.I had Sky disconnected in Sep.2005
On 3/08/05 they send me a letter confirming that they we're sorry that I was leaving them and they would switch off the Sky Tv on 03/09/2005.
They then sent a bill for £67 for 17/09/05 to 17/11/05 ? I phoned them and explained but they send a debt recovery company after me in Dec2005. I sent a copy of my termination letter to this company and it went away.
I phoned Sky yesterday but they say it is still on their "system" so there is nothing they can do, computer says "no".
What do I do Now? the debt seems to be growing and I can't get them to listen to me.:(

    Do you still have a copy of the termination letter they sent you? I'd send them another copy of that and look at the unenforceability thread too, as, regardless of whattheir computer says, it's nearing the time where they couldn't enforce it even if you had actually owed them it in the first place.

    The way I have dealt with this sort of problem is to involve the County Court. Write a letter setting out the facts and indicating that you dispute the claim and that Sky should initiate Court action if they wish to persue the matter and that you will counterclaim. Send this by recorded delivery to the Company registered address. In this letter you should state that you will charge a £10.00 administration fee to handle each and every letter from Sky or their representative debit recovery agency received after they have received your letter. The next letter you get send Sky an invoice for £10.00. After a few weeks send them a reminder and state that "time is of the essence for payment" and that if your invoice is not paid by a certain date (some weeks ahead as you must seem when you get to Court to have acted reasonably) you will issue a default summons for the amount of £10.00.
    This may seems long winded but it is unlikely you will get out from under the debt allegation ever unless you take the initiative. You can get a solictor to do it for you but it will cost you a couple of hundred quid.
    It will work: I have used this method to shoot down both British Gas and an internet provider.
    It goes without saying that it will only work if you are being honest about the facts and really do have a termination letter from Sky. All I had from the internet provider was a email from one of their customer service chappies.

    Take the unenforceability with a pinch fo salt, it applies to credit agreements. Sky is a service agreement so anything CCA related is not applicable. Although there are general debt templates in there that can be useful.

    Your issue here is with sky, and your general CS agent can't help. You need to write to sky explaining the problem, send a copy of the termination letter too. Writing usually works better.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

  • Yes , I still have the termination letter dated 03/08/2005 but their system must have reconnected me for some reason, but I wouldn't have known this since I didn't use Sky after September. They say they have no record of this termination letter, and they would have seen it as a missed payment in september when I cancelled the Direct Debit.

    I had the same issue with Tiscali (except they had been taking money from me regardless so they owed me money :mad:). Sent them copies of all the letters they had sent me about it, including my MAC code and a rather prickly letter asking them to refund my money as soon as. Ddin't get all my money bacj but they stopped threatening any action so I couldn't be bothered to fight for the rest.

    Tey're just now on my "never use again" list, along with Talk Talk (BT would be there too except I need my landline to be with them and Talk Talk are worse! ;))

    sent letter and phoned Sky and it was sorted out.
    They said they would take me off the system in March. Phew.

    Got a letter today demanding the outsanding bill from another debt collecting agency......!!!!!!

    Just luv SKY TV !

    Maybe a 'prove it' letter to sky, stating the closure of the account and recording that the matter has been closed - asking them to prove the debt or write to formally close the matter, otherwise you considerit to be in dispute. Plus a letter telling the DCA to refer the matter to sky as the alleged debt is in dispute and let them fight it out among themselves
