direct debit indemnity
I have a cahoot loan which is being taken over by Santander. They "accidentally" took 2 lots of £75 (my usual payment) because they took one on 24th and another on 25th. I think this is because the new direct debit was set up (not by me which i don't know if thats legal anyway) before the old one was cancelled. They told me to reclaim the new one that said "fixed rate" next to it from the 25th under direct debit indeminity from my bank. I just spoke to my bank and they said they will do this but they have to check with cahoot. Well - they have messed things up this much already so I am not too confident about that process... My mortgage comes out next week. Has anyone any experience of anything like this?

Hi, I have had to use the direct debit idemnity on a couple of occassions. I just rang my bank and asked them to return the direct debit under the indemnity, thay have never said they have to check with the payee and have returned the payment immediatley, so not sure why your bank is saying they have to check with cahoot? I bank with NW if that's any help.0

I guess i will wait and see. I have done all I can. Willchase on Tuesday if the credit doesn't appear. I always feel like i have to spoon feed these call centre bank people and make as many notes as i can of names of people i spoke to, times etc in case it bites me on the bum.0

The bank should raise the indemnity on you behalf and then they take it up with the company.
I suppose from the banks point of view they will be questioning why Cahoot didnt take reponsibility for their error and refund you themsleves, rather have you chasing your bank and then your bank chasing Cahoot.0 -
i did question that myself and they said they could refund me but it would take 19 days if they did it and my bank would be able to do it alot quicker. Its HSBC i bank with.0

My understanding of the DD indemnity is that your bank should refund you "up front" and then take the matter up with the company/bank that duplicated the claim in order to gain reimbursement for themselves. Where the debit was claimed in error by a company, it is their sponsoring bank that should sort it out with your bank.
This is how we applied the DD rule at Nat West.
