Help with HSBC loan please!

Hello,
I'm going through CCCS with a DMP and am paying off approx £200 a month to HSBC for a loan £15000 and an overdraft (was down to £125). Had a phonecall from another lady from them the other day asking if I was aware I'd missd lots of payments etc etc and I informed her politely that, yes, I was aware, I was going through CCCS and they would only be getting the £200 payments from me and, yes, I knew that it would end up being dealt with Metropolitan debt collection etc. She asked if she could transfer over one payment on 27/08/06 when the money was in there and I said yes. Just looked at my account now and they've taken the full loan amount out (£320.62) taking my over draft to £136.42 over the limit. I'm fuming as I didn't authorise it. I just phoned them and they said I had to phone credit services who had gone home so will phone them tomorrow. I've been doing my DMP since March now and have had problems with HSBC accepting smaller amounts which is fine cos I wantit to go through to Metropolitan but this has made me so cross. I asked the man on the phone who authorised the payment and he said that they didn't have to have permission. I stated I had cancelled my S/O a long time ago, had been in constant contact with them over it all andhe said that "as there were sufficient funds" they could take my payment...but there weren't, cos it took me £136.42 over my o/d limit!!!!! He couldn't guarantee that I wouldn't get charged either! I asked for my last 6 years statements to get me on the way to claiming back charges but was wondering whether anyone else has had things like this happen?
Also, my other half is going to pay the £228 to clear my overdraft for me cos it seems they just keep taking payments from this account. I am then putting it in writing I want this account closed. I've closed all other accounts with them so hopefully the payments from CCCS should go straight into the correct account - finally!

you will have no joy in closing account because they need an account from which to collect the laon payment if you pay the overdraft they will take payment again, i was also going to claim back charges but like lots of people on here pointed out they dont have to accept any payments andwhen you owe them high amounts iots better to not aggrivate them at this stage anyway, leave it over the overdraft keep the money in your pocket, your account will default in a min and it will go to metro im waiting for my loan one to finally go there, i will be paying them for 20 years at this rate but no more interest is looming on it

oh and to add i cancelled all my payments also they reinstated it apparently they canLIGHT BULB MOMENT, JUST IN THE NICK OF TIME!

This happened me with the Woolwich and I tried to close my account but it was such a hassle.
In the end I cancelled the overdraft and only keep 1p of a balance that way they can't take anything, mind you it's a wonder they haven't taken the penny!!!!
Whatever you do don't clear the overdraft as they will just keep taking out what you put in, been there done that!!!
Let it sit and it will get handed over eventually.
Unfortunately it does state in most T&C that if you get into arrears they can take money from any account that you may hold with them but you never think it will happen to you and I know I didn't read the T&C's properly until this happened, I will in future though.Debt at highest May 04 - £65,639.22 - Started DMP with CCCS 1st June 04 & now self managed DMPDebt now 20th December 2015 £31677.13 Paid Off to date £33962.09 - just not going quickly enough!
Debt free date July 2024! I don't think so, it'll be going quicker than that!!!

They are 'setting off' one account against the other. You need to open a basic bank account with a bank you have no other ties too and have your salary paid in there. Then notify HSBC in writing that you are defaulting on the overdraft. Tell CCCS to add the overdraft amount to your list of debts, it then becomes just another debt. They will try to add charges to the account because you are overdrawn but you have already initiated reclaiming your bank charges so just see that through to a conclusion and get them back.

HSBC did the same to me too, many times. They even allowed an old S/O to go through that had been cancelled months prior. They said I never cancelled it and let it go through. I went through the entire complaints procedure and in the end they offered me a loan to cover what they allowed to go out of my account. I even recorded a phone conversation when I was at work, where the woman in the credit debt admitted it was their error and I would receive a full refund and refund of O/D charges. They took months and then told me they lost the archive that contained that particular phone call and that this woman was mistaken. I sent them a copy of the phone call on tape and they said it wasn't admissable to anyone as I could have fabricated it !!!! Funny cos my work colleagues were in the room at the time and heard her too. They suck, they really do. I have never resolved it with them, they don't want to help at all.

HSBC Indian call centre are iditots. They know nothing about British banking and this lady probably didnt even know what a DMP or the CCCS was. All they do is ring up asking if you can make a payment and no matter what you tell them they'll ask again and tell you that your credit record will be 'seriously affected'. I would never take a call from them again.Debt as at 12th July 2006 - £61,345 :eek: :eek: :eek:

From day one I've always had my salary paid into a different account and my o/d is counted as debt with CCCS but that doesn't seem to make a blind bit of difference to the idiots at HSBC. The only funds going into that account is the £9 odd paying my overdraft back through CCCS. Just looking forward to potentially claiming back any charges!! Thank you xxx0
