letter from dca (scotland)

hi recieved a letter from resolve call today
we are acting on behalf of mercers debt collections ltd and have been instructed by them to collect the outstanding arrears due to them by your barclaycard account ,etc
failure to do so may lead to a personal visit being made by one of our reps to your home to collect payment should you fail to contact us, we may commence legal procedings to recover sums due
should i e mail them and tell them i am waiting for one of my creditors going to court for a charge for payment (scottish law ) or just ignore them

    Firstly pls dont stress about the letter that you have rcvd today i have rcvd loads of them from mercer(also on behalf of barcleycard)...............they never once came to the house nor did they send anyone out to the house..........also pls dont call them and let them know that you are waiting for a charge for payment as this may encourage them to up the pressure and hound you even more if you can just store all the letters that you get from them and try and ignore them.

    i am not stressing about letter i just wanted to know if i should quicken process along .

    I agree with weewilly winkie's advice. If you try to call their bluff, I doubt if they'll serve you with a charge for payment - they'll just try to hassle you more :mad:.

    It might be worth asking if Scottish posters mind sharing their own experiences of creditors who serve a charge for payment. I know that HMRC and councils are 'the usual suspects' [rollseyes] :eek::D. But do any of the banks or credit cards actually go down that route? And, most importantly, which ones?

    1 council -overpayment housing benifit still owe .£480
    2 halifax £4000
    3 mbna, £5000
    4 hitachie capital~ £1200
    5 barclaycard _ £3000
    6 rbs _£3000
    7 rbs loan _£3000
    8 rbs overdraft £500
    9 gov - overpayment wtc £1200 but not chasing me for payment as of yet

    I hope that some of our other Scottish posters see your message and can help out with telling you which creditors might serve a charge for payment.

    I can tell you that only the ones who are owed more than £3,000 can apply to make you bankrupt themselves.

    But, as long as you owe more than £1,500 in total, you can use an unpaid charge for payment (for any amount) to show that you are 'apparently insolvent', and apply for your own bankruptcy.

    I don't see any of your creditors actually taking you to court in the very near future I'm afraid

    OP of CT benefit will prolly be reclaimed from any current benefits same goes for CTC

    Its quite difficult to prove apparent insolvency in Scotland
