My partner was recently made bankrupt. He is still married although has been seperated for two years and his wife has also been made bankrupt. They have 1 child for whom he has to pay maintenance, although this is not agreed. He was paying an extortionate amount of money in rent, so we decided that he should come and live in my house, which I own solely in my name.
He has his interview with the OR next week. If he tells the OR that we are living together, could this affect the amount of surplus income they think he has. We have agreed that he should pay me some rent, and also contribute towards the bills, since I would be out of pocket otherwise.
Alternatively, if he tells the OR that he is renting a room from me, are they allowed to come and check on our living arrangements?
Also, he wants to file for divorce - am I correct in thinking he would be better doing that while bankrupt than after?

Hi Flying, whether it will effect his surplus all depends on how much living with you is compared to living by himself. I presume you have all the usual hosehold bills such as mortgage/rent, council tax, water, insurance, electricity, gas, housekeeping, that you will be expecting his to contribute his fair share towards?
The OR won't come and check your living arrangements, but if you are living as a couple this is what you should tell the OR, not that he is a lodger.
His BR should ahve no bearing on his divorce whatsoever.

Thank you for that - will tell him to be honest. He was just trying to protect me I think.
He couldn't actually afford where he was before at all, so it is a alot cheaper with me... and yes - he is contributing towards his fair share of the household bills.

Ideally a divorce should be completed prior to a divorce, as a BR would have an effect on the divorce settlement etc and a BR order overrules a decreee absolute.Total 'Failed Business' Debt £29,043
