To go for a CO, I believe they have to get a ccj first and you then will needed to have failed to keep up with the agreed payments on the ccj.
Is the debt joint or in one name. Is the property jointly owned??

Today who should turn up on my doorstep but a debt collector from Scotcall. Talk about things moving fast. What the hell can I do now? I have started a new thread on this but would welcome the advice from any previous helpful people!!!
I told him we were paying all we could afford and he want after sitting in his car for an hour, scaring the kids, told me that the only way to avoid him coming again would be to ring EGG!!! (NEVER!!)
I would have told him he was welcome to come again and sit outside in his car and if it helped him I would confirm to his bosses how long he sat outside.

We have been dealing with egg through agency for 3 years regularly paying every month not a payment missed, they are now taking us to court to get a charge on the property saying that they have been instructed to do so by Egg themselves. We don't have a leg to stand on as they are saying they just want to secure the debt. They don't give a hell monkey they just want their money.

It seems you would have to have a CCJ first, of which you have not kept up the payments. This company needs seriously killing off!

Also found a letter (post 5) that might be relevant to you Jim.

    Dear Sir or Madam,

    Account Refs xxxxxx & xxxxxx

Please be advised that from now on I will only communicate with you in writing and not by your representative that calls to my house [STRIKE]every week[/STRIKE], no matter how pleasant they are it is still intimidation and using bully boy tactics to extort money that I have not got.

Furthermore, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you or your representatives.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    Yours faithfully

Have you cca'd Egg? Or the DCA? As long as you are making regular payments, they can not make you pay more than you can afford.
I e-mailed that exact letter last night to Scotcall and had the following reply this morning:
    Good morning

Thank you for your email, I can advise that this account is closed with

Result! As long as you are making the regular payments on time, they should leave it at that. However be warned that Egg will most likely look to sell the debt off to DCA instead of appointing a rep like above. Either way they will let you know but hopefully it won't come to that. ;)

Just a quick update on my EGG problem! Today after writing an official complaint to the CEO of EGG (Bert Pijls), I have received a positive response and a letter answering my questions instead of just standard rubbish. Someone has taken the time to listen to what we have had to say, they have put the account on hold, and confirmed that no further doorstep visits would be made. It even states they would like us to accept their apologies and will review our offer of payment upon receipt of another income and expenditure form.

Another thing is the CCA received from them, states the words Approved and I am sure that means I can send the response detailed in another post? Can anyone confirm this?
