CSA ignored

Hi - my first post so be gentle!

I am the PWC and have been since split from my partner in 2003. He's a great Dad to the kids and adores them all. He has stood by his resposibilities to them.

Until Xmas 2004 (when I started working full-time) I was advised that I HAD to use the CSA to claim maintenance(as for 1 year I had to claim benefits). My ex was on JSA for that period.(ie his contribution would be £5 pw)

In 2004 I started working full time, phoned and spoke to a CSA advisor telling them I wanted to close the case as I was working full time and we were going to set up a private arrangement. I was advised that the case had been closed by the telephone operative. Heard nothing further until January 2006 when CSA wrote to me asking me if I wanted to pursue a case. Again I told them NO, private arrangement in place, was happy as things were, herd nothing further until January 2010 when a letter arrives from Marstons, addressed to ex (we share same initial, also previously shared address - so this maybe why?) stating that they were after 5K under a liability order that had been granted(last year)- I opened it to find address to return. Ex has moved a couple of times in last few yers but since I'd advised him the case was closed he never gave CSA a forwarding address. Liability order runs for the whole period I was working and we had a private arrangement in place, so I do not understand

a)why it was granted in the first place as I had repeatedly asked for the case to be closed.

b) the amount it has been granted at. Ex started a new career and has been an apprentice for four years and I know his take home DOES NOT exceed £100 p.w so for the four years they are claiming the liability order for, £5 a week x 52 weeks x 4 years doesn't add up to 5K anyway.

c) I have never been informed by CSA liability order granted as I would have appealed it myself, we are now past the month 'cut-off'.

Where do we both stand? I don't agree with the liability order as the figure is wrong, we had a private arrangement in place and he IS a good parent to our children. He obviously very upset about it - now it's causing arguments between us over the issue.....all down to CSA maladministration and it's driving me to distraction - HELP!!!!

    I understand that as from October 2008 I am no longer obliged to involve the CSA/CMEC in any matters relating to my child support payments. I therefore ask that this be taken as my official request to close the case, reference number above, forthwith and that no further action is to be taken against the non resident parent.

    I have also arranged for any debts owed to me to be settled privately, and thus request that all monies owed to me on the above said reference number are cancelled with immediate effect and no further enforcement action will be taken.
