I think you will find the CSA do use tax credits.tamsin1982 wrote: »I never thought tax creds were included on a csa 2 case, it should be 15% of his net income after the % for your children at home had been taken off!
go on to there website and use the calc and see what it says, then obv follow up with a call to csa - are you sure they took off % for the 3 children you have in your household? hopefully a simple mistake somewhere x
We work out child maintenance by applying one of four rates to the non-resident parent's income. Income is earnings, money from an occupational or personal pension, and tax credits. We use the amount of income left after things like income tax, National Insurance and any money paid into a pension scheme have been taken off. This does not apply if the pension is set up to pay off a mortgage, when only 75% of the money paid into the pension scheme is taken away from the non-resident parent's income.

I think you will find that those on benefits no longer need to go via the child support agency, so they "don't just jump in"battlestarone wrote: »Your local mp may be able to help, this is an outrage....
The csa system is a shambles,it should only be the absent parent income taken into account, but they dont, they take into account how much you pay and he pays to ward your household expences, simple way would be for 1st child he pays simple 15% of his net take home pay, then close the file, simple, but the govement want to screw people for every penny,i bet your man ex has become unemployed or has started claiming some sort of benefit, this is when the csa jump in,,,,,maybe bst contacting the mother and sorting something out to get round this, maybe to late though.*SIGH*

Well after a very confused phonecall with csa.. they couldnt find my partner on their records at first and then when they did they told him that they had a different address for him then the one he was telling them he lived at(how he received the letters is anyone's guess)they have said they are going too double check it and get back too him:mad: in the meantime he has made an appointment with the law centre ,he is also appealing the decision if it remains unchanged and we will go too our mp ,My partner is more than willing to contribute to his sons upbringing as he always has done .battlestar they did have a private agreement in place but for one reason or another she has decided that she would go through csa ... we cant contact her as our phonecalls are never answered even when my partner is trying to contact his son ,any birthday/xmas cards/presents/money that we send too him are never ever acknowledged ..before she moved away we all got on fine there was never any problems at all regarding contact,cm etc0

On CS2, WTC are regarded as the income of the higher earner. If earnings are equal, then it will be split 50/50.
CTC are deemed the income of the NRP.
If you have 3 relevant other child living in your household, you will receive a 25% reduction for them, prior to 15% calculation for the qualifying child.A fairer CSA for all0 -
I dont understand how ctc can be deemed as nrp's income ..as i claim them for my children and they are paid to me and in my name...the pwc partners income is not taken into account so why should mine? it makes no sense at all especially considering the ctc is what the government say my children are entitled too .. the pwc will claim ctc for her child so why should money be taken away from my children ? this may sound harsh but i have no responsibilty toward my partners son from a previous relationship0

I completley understand your frustrations, I've struggled for years with this injustice! It's the only part I begrudge of my DH having to pay CS to his other children. Why should the CTC get taken from children to pay for children who already have their own CTC entitlement.
Especially when CM is disregarded as income for the PWC when claiming CTC for their child. Honestly I'll never understand how they can use that money, I'll never believe it should be taken and I don't think theres any justice in using it. Makes my blood boil!0 -

I'm not disagreeing...
However the flip side is, the qualifying child/ren's assessment is made after any relevant other/s are taken into consideration.
I expect there are some PWC's that, like yourself, feel no responsibility towards their ex partners step or other child/ren from their new relationship and do not understand the deduction for such.
In your own case 25% of the NRP's income is disregarded for assessment purpose. This is made up by 2 children from your own previous relationship and 1 that belongs to your OH. The QC assessment is then based on 75% of the NRP's income, less any shared care element.
As I have said, Im not disagreeing, but there are two sides to the coin.

I agree there are two sides to everything but I believe that PWCs who do not agree/understand a deduction based on future children/step children in the nrp household must believe that the nrp has no right to a future life after their relationship ends.
I personally was shocked to discover that 'my' payment of child tax credits was counted as his income for cm calculations. I truely believe in CM and have fought for the last 5 yrs to get oh's pwc to accept a regular payment instead of cash under the table lump sums. However I still don't understand how an award of money made by HMRC to help with my childrens upkeep should be passed straight to children in another household.0 -
The new gross system from 2011 will be based on a person's income before tax is taken or tax credits are added.0

I do not in anyway begrudge my partner paying cm for his son , after all i have two children from a previous relationship and i have not had one penny from their father in about 4 years i do understand fully how expensive bringing up children can be,Up until about 11 months ago both my partner and i were working full time and were in a financial position where we were able to contribute quite a high amount too his son
We have had quite a tough year and now i am no longer working and my partner can only work part time due to my health.
It seems that my partners ex wasnt happy when we had to reduce payments and i believe this is why she involved the csa
We were honest with her and wrote a letter explaining the situation but never did get a response
Its not as if we ever with held any payment and always sent extra for his son when we could ..Its not as if i am taking my own children out and spoiling them rotten but not bothering about my partners absent son
All members of our household have had too tighten out belts and start budgeting,0
