                    HI all,
Finallay took the plunge and arranged my br couldnt get in before end of march...shame but hey, CAB really helped me with forms and everything couldnt thank the Guy enough was really informative and helpful.
I going BR before OH he will have to wait some more months for us to save up, im lucky my dad offered to pay for me.
What i want to know is, we have a possession hearing on 16th feb, i sent forms in explaining no longer in the property and wanted it repossessing.
The court wrote to us explaining they had granted the order to lender and to vacate as of 16th march.
anyway called up monday and the locks haven't been changed so they haven't taken the house also got a letter from the solicitor dealing with it and they are now saying lender wants to some form of offer to pay or they will go for some sort of warrant?
I'm really confused? is it best to cancel my BR and wait for house to be repossessed? i am mainly going BR due to the large shortfall which will happen, my personal debts are only 7k .
Thanks sorry for long post x

When you go BR has no bearing on when they will repo so go ahead and proceed as planned.
The warrant they are referring to is the warrant of execution which is the green light from the judge for them to take possession of the property.
This is different from the notice of intention which is basically the order that tells you to vacate. That's the one that gives you the 28 days to take your belongings etc as after that they have the right to seize and dispose of anything left behind.
If you go BR before the repo which is obviously the way it will go if you have date booked for end of march then the shortfall will be included once the property goes back to the bank.
Hope this helps, keep posting if you need more help. There used to be a street named after Chuck Norris, but it was changed because nobody crosses Chuck Norris and lives.0 There used to be a street named after Chuck Norris, but it was changed because nobody crosses Chuck Norris and lives.0
