Hubby officially bankrupt

Well as of 12.00pm today hubby is officially bankrupt.
He is really low said he feels worthless and seriously regrets every trying to run a business in the first place.
Unfortunately our court (portsmouth) wasn't as nice as some of the ones on here but he said they were professional and at the end of the day just doing their jobs.
He wanted to do it on his own and I had to work so he went at 10.00am and had forms checked, paid the fee etc then they told him to go back at 2pm and may have to see the judge or speak to the receiver.
When he returned at 2pm they said judge didn't want to see him and he was officially bankrupt as of 12pm.
Only concern I have is he told the court officer about the pending charging order and she asked him if that's why he went bankrupt and he said it was, I said didn't know if he should have said that as they might not view it too kindly, she said she would ensure note made that he is now bankrupt and tommorrow he is going to notify the solicitors and send copy of the bankruptcy notice to them and the court, also let the OR know.
The other thing was he did'nt notice til after he got back that at the bottom of the form was a note saying to contact the receiver immediately at this address in Southampton and phone number was there but they closed at 4pm and he didn't see it til after then so he will ring them first thing tommorrow.
Anyone know whether he will actually speak to the receiver or will it be someone in the office who just books an appt with the receiver?
thanks

Usually they will just book an appointment. On the rare occasion he may get to speak to OR immediately. Nothing to panic over though. Usually like you to send paperwork first, so not very likely.0

Hi Munchlet, dont worry about the note at the bottom, it has been there for years and doesnt really apply anymore, there was a time when you did have to go see the receiver immeadiatly. Almost no one actually speaks to the OR, there is only one per officie and is like a figurehead. He will have 2 people assigned to his case, in most places you speak to the case clerk first who asks a few simple questions and books an appointment with the examiner who actually does the interview.
As we said befoe be pro active with sending the BO to the judge handling the charging order dont rely on any one else to do it.Hi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

First things first... he's not worthless! I too went bankrupt after my business failed but i don't see it as failure, i take the opinion that i tried to make my own way in the world and it didn't work out, that's what being in business is all about, it's a calculated risk and you're more of a man for trying and failing than you are for sitting and wishing, but never having the guts to try it. Ok the business failed, big deal. There are more important things in life than your credit rating, life will go on and the day will come when he bounces back stronger than ever.
I found the OR to be really pleasant, i think we all have the same sort of thoughts when the time comes but the reality is never as bad as you imagine. In my case i was contacted by a clerk who made an appointment for a telephone interview. At the appointed time the call came and it took maybe 40 minutes. Tell him not to worry, the worst is over, the rest is simply dotting the i's and crossing the t's.
It's one year out of your life, the worry ends, sleep returns, you can answer the phone again and start to live life, have a drink and raise your respective glasses to bankruptcy, it's a life saving lesson and it should be embraced, nor feared.0 -
Thanks guys you are great:T
To be honest I feel better already just knowing that things will now get sorted one way or another and not having to avoid the phone and dreading the postman.
I've told hubby to ring the OR office tommorrow and then we will send copy of the bankruptcy order to the court and the solicitors acting for Natwest.
One thing we did notice was that the judge who granted the interim charging order was the same judge that granted the bankruptcy so hopefully once we put it in writing he won't grant the final order.
thanks again, will keep you posted.0 -
Congratulations to you and hubby M, upwards and onwards now x:beer:"If wishes were horses, then beggars would ride"
