CCJ Help

I have debts for a credit card and a personal loan from around ten years ago. I have not paid anything to them for around 8 years due to illness, I have just received a letter from Rockwell asking me to pay the credit card debt of £2313.

I have disputed this with one of the template letters from here and am waiting a reply.

With all this going on I decided to check my credit file, my experian report is clear but on equifax there is a CCJ for my loan which was £16k, the CCJ is for £24k.

I was never told that this was going to court or even received any mail asking for me to repay, can they just put a CCJ on my report without me knowing ar even asking me to repay, and why would it now be £24k. Where do I stand with this?

    What template letter did you send in relation to the credit card? Was it the 'prove it' letter, a statute barred letter or something else (perhaps a CCA request?)

    Do you still live at the same address that you lived at when you took out the loan? What is the date of the CCJ and did you live at the same address on that date as when you took out the loan?

    (the additional cost would be late interest, late payment charges and possibly court costs)

    No I have moved since, the CCJ was in March 2007, around the same time I received a letter dont know if I kept a copy and cant remember who it was from but it said

    As a gesture of good will we will accept a one of payment to settle this account, I managed to raise £5000 and sent the letter back with my offer.

    I never heard anything back, who should I contact to find out a breakdown of the debt for the CCJ.
    Why would Rockwell only be chasing me for the credit card? have they bought this debt? And yes it was the prove it letter. If they can prove it what do I do then? Or what do I do if they cant?

    The credit card debt is probably statute barred - there is no obligation on you to pay any debt if there has been a period of 6 years or more (5 in Scotland) when you have neither paid or made written acknowledgement of the debt. You need to send a statute barred letter if this is he case as the company are allowed to ask you to pay if you do not write to them.

    THE CCJ paperwork should have been sent to your address for you to dispute if you wished to.

    You may be eligible to get the loan judgement set aside.
    If so you could then negotiate to make repay the debt (so they do not get another CCJ issued). This debt is unlikely to be statute barred as your letter from around March 2007 will be an acknowledgment of the debt.

    Hopefully the CC will be SB though.
