Does bankruptcy appear on a CRB check?

Hi all,

Well bankruptcy looms for me and my partner, Its so scary now:eek:

I offered the Halifax £4000 to clear a 19k debt but they didnt accept (had a feeling this was a but too low). Then went at them with a counter offer of £7k which relatives offered to lend me. They still was not interested even though I told then our only other option was bankruptcy and as this money was being gifted (well long term loaned by my family) they would end up with nothing. They said they could not accept any short payments due to company policys. It makes you wonder who sets these policys, dont we (the tax payers) actually own most of RBS at the moment??

I could not beleive the way the first bloke spoke to me he was trying to worry me stupid about bankruptcy saying this will go down on your CRB check which will affect you getting future jobs (is this true?):think: I know that its the courts we are dealing with but do they actually brand us as crimnals by bringing it up on a criminal records check?

Any way I thought I would scare him a bit at the end of the call after he worried me stupid about bakrupcty and tell him the call had been recorded for my own protection (it hadnt but he dont know that) so if he was lying he may think he is in big trouble now:rotfl::D. Any way when I called back the to offer the £7k the bloke was the total opposite and could not have been nicer to me and was sorry to hear I would have to go bankrupt and there was nothing he could do for me.

Any way got our dates 22nd apr and 5th May. Strange dates considering we called the court within 5 mins of each other and I called first and got the 5th May as earliest?

Oh well here we go life changing months April and May will be! Homeless Potless, depressed and soon to be bankrupt. I suppose now on a positive note The only way is up.

Oh and starting to get Vanquis credit card applications through APR HOW MUCH!!!!!!! you must be joking! :mad: lol

    As far as I'm aware no, as a CRB is for criminal convictions, and BR isn't a criminal matter. Speeding fines don't appear on your CRB either so very doubtful BR would.

    A CRB will not show BR as it is not a criminal offence unless you have commited fraud.

  • No, bankruptcy will NOT show up on a CRB check - I was very careful to check this before I went br. He was talking out of his !!!!, tbh.

    I thought this was the best thread to add this to. I am applying for a new job at the moment (within the NHS), and need to complete one of those CRB declaration forms.

    Most of it is very straight forward - i.e. I've never committed a crime, been convicted of a crime, received a police caution etc. - but then there is this question:
    Have you ever been disqualified from the practice of a profession or required to practice subject to specified limitations following fitness to practice proceedings by a regulatory or licensing body in the United Kingdom or in any other country?

    Of course, as an undischarged BR, I am not allowed to be a director of a limited company. I was a ltd co director before the BR, but not anymore. There are no particular issues in my case, i.e. I'm not being investigated for any sort of misconduct (in fact, nothing has really happened with the company at all since I resigned). In fact the next question on the form asks if I am being investigated regarding fitness to practice by any licensing or regulatory body, which I am not.

    I'm not sure what to answer for the question I quoted though. Whilst I'm not ashamed of being BR, and will admit it is asked, I'm not sure that offering the information if it's not required would help with my chances of getting an interview. If it makes any difference, the job I am applying for is not what could be considered a 'corporate' or managerial posting.

    Onward, if you look very carefully at the wording, the answer is NO you haven't.

    Have you ever been disqualified from the practice of a profession or required to practice subject to specified limitations following fitness to practice proceedings by a regulatory or licensing body in the United Kingdom or in any other country?

    This would indicate some sort of hearing, trial, or otherwise where your fitness to practise was specifically questioned. As being a co director is a clause of BR and NOT a finding by a regulatory or licensing body in a specific case, you haven't been found 'guilty' of this as it were.

    This clause is put in to highlight people who have been struck of the GMC register for eg for doing something naughty whilst being an MD or similar (or I guess a teacher being struck off by the GTC, even though it's not relevant).
