csa bolton still waitin 8 yrs for payment from ex , can i get compansation

I first put a claim in with csa 8 yrs ago i have almost given up on ever getting anything as so far i havent recieved a penny for two children, every time i ring i get passed around britain to all the diffrent call centres because they dont know which one is dealing with it, cab has even rang on my behalf 5 yrs ago and they did the same to them, cab told me i might as well give up trying, after which though i got a letter saying it had been sent to the clerical team in birkenhead??? and they would contact me within 28 days. nothing happened so i written to john oliver the area director for north west still nothing another 5yrs later, i have been ringing every few months for 8 yrs , my ex does not see the kids ,at all never really has not done since 2002, they always seem to tell me when i ring i myself stopped the claim which is totaly untrue. today i rang them again threated to sue them and my god i wish i would of done this yrs ago, they even rang me back first time in 8 yrs result. they told me it had been passed on to the bolton office i said ive heard that one before anyway they put me threw, now they have promised to contact me in the next 5 days heard that one before as well, my question is is there any compansation i can claim , and could i really sue them ? not after money really. but would be handy , but they should of done there job propley in the first place instead of causing me and my family hardship all these years and yes some might say my ex did that which he did but , thats why the csa was set up and i do pay all my taxs, my ex should be made to pay, why should he get away with this when people have been sent to prison for missing payments, i have given them every detail of his date of birth address ni no, they have had all thet for 8 yrs, if anyone could advise me about this i would be gratefull pls thanks

if he is dodging the CSA there isn't alot that can be done. He might not be working, or they might not know where he stays now if he isn't on the electrial roll. Could be alot of reasons. Very much doubt you will get anywhere by sueing. There are people who have been waiting alot longer than you.0

ive told them where he lives, in number every thing , and if he did give up his job they still take a fiver a week out of his benifit, i know thers been people waiting alot longer than me but that doesnt mean i should give up, or i have no right to try, i was after abit of advice thats all0

Bring honest you would be suing a government department so I doubt you would get far, however have you put in a formal complaint? You can put in a complaint via their website and it will be passed to the complaints dept at Bolton. I would also contact your MP and get them to complain on your behalf - it always seems to hurry them along if there is an MP breathing down their neck!
If you get them to investigate it sounds like you may get compensation for maladministration and if they know where your ex is etc, then you may get the arrears as well. If you opened the case in 2002 then you are under the old rules case, so it will have to go clerical because the computer system cant cope. That will take around 4-8 weeks to rebuild the case and then it will go to a named case officer who will be your contact, make friends with that case officer because they are the person who drives the referral to criminal compliance etc.

As Kimitatsu says, you need to put in an official complaint. I would suggest that you do this in writing, sending the letter by recorded delivery so that you can prove they get it. If you are not sure which dept. is dealing with your case at present, send it in to a few. Give them a time limit to reply, say two months, then if they don't reply by then, write to the ICE. ICE probably won't accept the case at that point but they contact the CSA which will 'remind' them to deal with it. When I have done this I have always received a reply about two weeks after writing to ICE.
I had problems with being passed from dept. to dept. and nothing being done for years, and looking back I was too complacent and trusting. Now I don't believe anything the CSA tell me until I see results! Since complaining in writing about every little error or unnecessary delay, they seem to be dealing with my case a bit better. There's probably a note on their computer system telling them to take notice of me or get another complaint next week.
BTW, you can close your case, wait 13 weeks and get on to the CS2 system and keep your arrears from the old CS1 case. It's not easy but I did it. However, I would let them sort out the CS1 case first and then worry about changing to CS2 if it would be better for you.
Don't give up. I know it feels like banging your head against a wall, but it's your children's rights you are fighting for.0 -
Hi thanks for all the advice, upon which i have just i sent an email to the ICE , as i have allready sent letter to csa bolton recorded without any results, on the website it says someone will contact me within 5 days so fingers crossed, but from now on am going to keep hassling them writing letter sending recorded ect , till something gets done thankyou for your helpfull replys , i can now see the light at the end of the tunnel and wont trust in what they tell me on the phone, if i get no where in the next wk i will also contact my local mp, i will just give it a wk for ice to contact me thankyou so much you have given me hope of getting some where from your story.

I got fobbed around by Bolton, Falkirk and Dudley. In the process of chasing the CSA to do their job I lodged a complaint through my MP and got £275 redress, for the stress caused and the cost of phone calls.
