Cancelling David Lloyd Membership

My wife and I took out DL membership in March last year and paid up front. We moved house towards the end of last year and sent DL a letter advising that we would not be renewing our membership in December, within the 3 months notice period they stipulate. We received a letter from them last week demanding payment for this year so sent them a copy of the December letter. They have now said that they did not receive our original letter and the onus is on us to prove that we sent it. I sent the original letter by normal mail so have no proof of postage, other than the fact that I know that I sent it and that I'm not responsible for the failures of their admin department of which I was a victim of on several occasion during my years membership. Any advice on what my next step should be?

    I'm also having problems with DL :( They keep on demanding money, sorry I have no help but i'm interested in what I can do.
  • I'm having very much the same problem with Fitness First. I'd be intertested if you get anywhere. This seems like a standard revenue generating mechanism for Gyms.

    I wrote to FF back in December also and now they are claiming they never recieved the cancelation.

    I'd advise you to talk to the CAB about it, and if it were me, threaten to go to the bbc/newspaper/local newspaper with the facts, state clearly that you have the contacts and are also able to include a lawyer on anything if needed.

    Its threatening tactics but its the way I'd deal with that sort of anger!

    Me and my wife recently made the mistake of signing up to David Lloyds I wish I had checked this forum prior to doing so. Now that I have I am looking for the most effective way to cancel them. They signed us up saying that we would start paying in January. So I was wondering if I went to the club and talked about cancelling as it has only been only a day of us signing up would that work?

    Failing that I have decided to get a doctors note and am going to try and get a letter from work saying I am being sent abroad for 2 years so I need to cancel. If anyone has experience of this would be very grateful. If this doesnt work I am thinking of changing banks closing my existing account and address aas well as cancelling the direct debit. Any advice is appreciated.

    I'd just get really arsey. Book an afternoon off work to stand outside the gym with leaflets and when the manager (it will take 30 mins max) comes to talk to you, say you'll leave when they meet their T&Cs but otherwise you'll stay and be back on Saturday (or something). They're not worried about their members, but if a potential member talks to you, they lose thousands.
    Can we just take it as read I didn't mean to offend you?

    Do you have a physical problem that stops you from using the gym, if not are you expecting the doctor to lie for you, they wont, believe me.

    Are you wanting work to lie for you also.

    You signed a contract, why dont you use the gym.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    I'm afraid that just closing your bank account won't work - you signed a contract, which you were given to read and sign. They are therefore not only allowed to, but WILL pursue you for the money you committed to pay. If you cancel the DD/close your account, they will simply pass the debt to a debt collection agency, and continue to pursue you that way, and you can be sure the agency will add extra money on for fees as well. A one way ticket to a shot credit record for 6 years...

  • I have just recently joined a different gym, which I am happy with, but was told on signing the contract that you are given a 14 day cooling off period, during which you are able to cancel. I am sure this should apply to all contracts of this nature, so maybe that worth checking.
