I think its been said above already, but unless the FULL amount of the charge is paid off they will not release it.. They arent holding a charge for her half oany equity... U need to stump up the full whack i'd say..0

This debt charge holder doesn't care what you've agreed with the ex. All they are concerned with is the debt being paid in full to release the charge. There is no negotiation to be done; either they get all the money that is the outstanding debt or they don't release the charge. Whether your ex is then left with £5, £500 or £5000 is no concern to them.
NOw if your agreed formula (50% equity less 50% works or whatever) doesn't give enough money to pay off the debt lender they won't release the charge. So you will then be stuck with the charge still on what will be your property.
Once this happens I imagine the ex will pay nothing towards it. You will have to deal with the charge. Which means no selling the property without repaying it in full and no remortgaging (say 3 years time) without the charge holder agreeing a deed of postponement (which may need ex's agreement and costs £2-300).I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
