Are you expecting him to die any time soon?

    hi ,
no its a straightforward question, no i am not he is not ill an any serious way , but i am just safeguarding my home if anything WERE to happen during the BR , noone knows whats around the corner and then its too late.
i suppose i am going to have to ask him to change his will and give everything to my sister. it seems logical at least we would not lose the family home

It depends upon the date of death NOT when inheritance may be due. Anything before BR (That is claimable as an asset) and anything during BR (everything) is claimed by the OR. If a death occurs on discharge day or after, then no, nothing can be claimed.

And yes, I would speak to him about changing his will. My father amended his for the period I was BR, that until AD date, anything I were to inherit went into a trust for my chidren with myself as trustee.

The way I see it, is that it's not my money, nor the OR's. It's my Dads money and if wants to leave it all to the local dogs home or Ipswich Town supporters club (god forbid!) then he can. If he want's to change his will so that his money goes to whomever he wants, then he can. Although I feel he should spend it all on having a good time......
