arrears question

Hi hoping someone can answer this for me, My brother has been payin his ex money every month with out fail for 4yrs, his ex met a new partner last yr and got pregnant and as he's moved in she now has to pay full rent and has asked my brother for more money.
ive worked it out that he is paying pretty much right so he told her to call the csa if she wasnt happy which she has done. They sent a letter last November askin for wage slips and typically put it off an forgot about it!
he called them today after getting a letter asking for arrears of 1200, calculations had been done with wrong earnings and no deductions for him having his dd 1 night a week
theyre restarting the claim from today with the 1/7th deduction on it but they told him they cant take it off for the last 4 months so he owes £162!?
Also if he requested would he be able to put me on his 'account' so i can speak to them on his behalf?

    if he states in writing that he wishes for you to be a third party on the account then you can talk on his behalf.

    As he did not respond to them at the time, it is now too late for him to request any kind of reduction for that period I'm afraid. They can, however, correct it if it has been done using the wrong wages. Why are they wrong?

    theyve assumed them as he still hasnt sent them off! hes found 2 out so ll go post them tomo to try get this sorted out and set up!

    shouldnt his ex have told the csa in her claim that he has the dd overnight? I hoped as the assessment hadnt been done properly he couldve had the reassesment backdated properly but oh well he'l just have to learn not to put things off for 4 months in future!

    no idea but looking at the amounts theyve asked him for its way over what he actually earns!?

    he carried on paying her and luckily she has confirmed this with them!

    theyve called her back tonight about him having the dd one night a week and it would seem she had originally told them he has her less than 52 nights a year because sometimes they go away to her mums, but then missed out that he will sometimes have her 2 nights a week!
    Shes also claiming he owes her £300 for paying her £7 less a month than he shouldve been for last 4yrs? im not too sure how she is working this out and as she was on IS up until aug last yr the money wouldnt be owed to her anyway!
    She really doesnt know how lucky she is to have him, he even coughed up £60 last year as his half of school uniform! i dunno where she bought em but clearly not a place i could afford to go to!

    if he has to pay the full 7/7th for the last 4 months its not such a big deal cos it really couldve been a whole lot worse, just wish the plonker had given it to me to sort out in the first place :rotfl:

    There's not much she can do about the last 4 yrs as they only take into account payments from when they first contacted him, like you say, in November. So I wouldn't worry about that too much.

    Bit cheeky really when she's got a new fella and baby on the way, she's lucky to be getting the money she does after reading alot of cases on here where the PWC's get nothing!

    Ive now managed to work out whats happened, the csa were involved when they split but they went direct pay (probably because she was defrauding benefits!?) the payment was £143 which they thought was monthly so he payed her £150 just to round it up,
    when she called them she found out the £143 should have been every 4 weeks ( so really £155 calendar month) so its this £5 x 48 months (£240) arrears that she wants him to pay but him having his dd to stay every week wasnt in the original calculation so technically she owes him money! he has explained it to her and now shes told him to forget about it like shes doin him a favour!
    He really is one of the good guys and unfortunately naive, hopefully now tho he can pay her the right money and has learnt what does/nt affect how much he pays

    think the 'success party' was a little too premature!
    csa end sorted, standing order in place etc
    now the pwc has started with other things - has told the DD daddy will get you new trainers the weekend cos she has no money, apparently they have to be nike air max!! the girl is 6 and does not need a £30 pair of trainers!

    pwc has also text stating that after her baby is born (within the next few weeks) nrp will be having the DD to stay every other week as she wants to take both her children out not just the baby so older one dont miss out! why not just make him pick her up later on a saturday? because conveniently he will then have to pay full 7/7ths :mad:

    I really am soo angry and fully understand why us pwc get tarred!

    if she tries cutting down contact can he dispute this? obv not with csa but via court access etc? im guessin it would be costly :(

    Could he not just have her extra nights in the holidays to make up for the weekends so it evens out over the year?

    Let DD pick whatever trainers she wants :) then keep them with him!

    she stayed 6 nights after xmas and he now isnt allowed her for that long as he fed her crap, which he probably did but he cant cook an she dont eat!
    Im going with them in the morning and will happily help her choose a nice girly pair that are cool amongst her friends and not her mums!
    I must sound like a right cow :p
