    these guys dont stop at nothing and if i can get a letter from them telling me they dont have a CCA or they give me a dodgy one then i can send copies with my statue barred copies for a better case, fos etc are hard to please these days as they are so busy...

    for the sake of a quid i think il keep sending my CCA requests even if the debt is statue barred

    I have read your thread (started reading it yesterday, have seen the posts on it today).

    This case is not the same. Cross lips has no reason to request a CCA. There is no default showing on their file currently, all they need to do is prove its SB and 99% of the time that will be it.

    In the highly unlikely event that the DCA did then put something on their credit file after this point then they could easily defend that if it ever happened.

    You completely misunderstand this case. The CCA is completely irrelevant in this case. Even if they have a legally compliant CCa and default letter, if the debt is statute barred, that is the only defence required.

    i get what ur saying, but they have been doing it to me and my point is that 1, its a !!!! load of hassle to get them removed IF they do, and most people dont know what to do about it and they know this, getting caught say 1 in every 100 000 aint such a big deal to them. the worse punishment iv heard of was 450 quid fine to investigate a DCA and they are still trading!

    u get a cca, u dispute the account, u dispute the account, ur better prepared later if need be

    i mean, it been 10 yrs and they are still chasing....

    Thanks to you all for your advice. Ras to answer ur question why we are not sure. We run into some financial probs oh was made redundant and we had a few debts as a result (which I must say we dealt with and paid). We have been very good ever since. I do not recall the company neither does oh and tbh we wouldn't remember it's so long ago. Anyway as an update on current situation I have sent the copy of the first letter Recorded delivery with an accompanying letter saying I don't give them permission to come to my house. The limitation act and that if they continue to harrass that I will be getting in touch with the relevant people. So just gonna have to wait and see now what they gunna do now. I just hope this will be the last of it and we will hear no more.

    Well this is just an update really. Firstly I want to thank you all so very much for all your useful advice to deal with this situation I don't know what i would of done without this site and the kindness of some good advice. well onto the news I have heard from BCW this morning. "In light of my recent communication they say this account is now closed and i should not communicate with them any further". They even said not to hesitate to contact them should i require further assistance :rotfl:. Sending that letter by recorded delivery made all the difference and they responded very quickly,unlike the last letter that I sent.

    They will usually back down from statute barred debts pretty quickly, although some have put up a fight and failed miserable. Chasing statue barred debts is unlawful 'illegal' harassment so they have no legs to stand on.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
