A bit of advice please...

Hi.
I have just recently split from my partner. We do still live togther, but as it stands i am looking to move out in the not to distant future.
When i leave one of our kids will come with me. She has a child from another guy and used to claim csa payments from him. Years ago when she had the claim she was with me and we both had a joint clai for income support. She recalls that the csa collected from him and kept the money because we received an income based benefit.
If i move out and take one of the kids with me, even though there will be no CSA claim made will she still be liable to pay money out to them if i am on an income based benefit living with just one of the kids.
Sorry i haven't explained it too well, kinda finding it hard to understand myself as i can't recall this happening.

There is no legal obligation for anyone to use the CSA anymore. whether they get benefits or not. If possible keep things between you both.*SIGH*
