Welcome finance trying to rip me off

in Loans
Hello all
I will try keep it short.
I bought a car in August 2007 using welcome finance. (huge mistake).
The loan repayments began a month later in September 07 which is normal.
The problems started in February 2008 when they stated that I had missed 2 payment for December 07 and Jan 08.
They claimed that the actual loan started in November 2007 and that I should have made payments in Dec/Jan. I explained to them several times that the loan agreement started in Aug 07 with the first payment being taken in September 07 but they would not listen.
I checked my account and found that I had made 2 payments in Sept 07 and Oct 07 and told them that they had made some sort of mistake.
Cut to Feb 2010.. the situation is still not sorted and I have now received several letters from welcome stating that Im 5 months in arrears. I have sent a copy of the original finance agreement to Welcome Finance but they say that they have'nt received them.
I know for a fact that I am only 2 payments in arrears, but Im refusing to bring them up to date until they acknowledge their mistake from when the agreement first started.
What can I do about this. The company are totally useless. Ive written to them 5 times in the past 12 months but still they say they cant find my letters even though the address Im using is one they gave me.
Its almost like they are trying to buy time and stringing this out charge me extra for default charges and letters/phone calls.
Any advice would be appreciated.
Many Thanks

I'm not sure what you think you're proving by actually being in arrears?
"Oh they're claiming I'm in arrears. I'll prove they're lying by being in not quite as much arrears as they claim. That'll show them they're wrong about me."
These letters they've never received - were they sent recorded delivery? If not then perhaps copies of them should be.If you don't stand for something, you'll fall for anything0 -
You are being stupid. If they are banging on extra interest and charges and using your payments to pay them and not the loan, then you could well now be 5 months in arrears. Bring the loan up to date immediately and argue about it later.

Firstly, send all letters recorded delivery so they can't claim they didn't receive them.
Secondly, bring your payments up to date. Are payments made by direct debit or standing order? If so, ask them why the payments weren't taken out in the months you supposedly missed.
You will probably find that nobody is taking your complaint seriously as you actually are in arrears.0 -
I know for a fact that I am only 2 payments in arrears
With Welcome you really don't want to be in ANY kind of arrears. You are making it easy for them.I used to think that good grammar is important, but now I know that good wine is importanter.0 -
so why not pay the 2 months that you know you are, go down the formal complaints and then goto the fso. Your really not doing yourself any favours0

RobertoMoir - Firstly Im not trying to prove anything by not paying the arrears. Im well aware of the situation relating to arrears and I can handle that.
Secondly, all post HAS been sent recorded signed.
Xbigman - who you calling stupid. There are'nt any extra interest charges.
It seems that no one that has attempted to comment has anything remotely helpful to say. I suggest you dont bother.0 -

Then as has been suggested you may want to go down the formal complaint route. But having actual arrears as well as their made up ones will seriously muddy those waters.sjrinteriors wrote: »Secondly, all post HAS been sent recorded signed.
Fair enough. One has to ask. If you can prove the letters have been received then using this against their claims not to have received the letters will help demonstrate their ineptness if you pursue a formal complaint.sjrinteriors wrote: »It seems that no one that has attempted to comment has anything remotely helpful to say. I'm not sure why you think no one has attempted to say anything helpful? I think both my comment and my question were pertinent, and I see you've received other advice too.
You might understand that "of course" you sent everything by recorded post, for example, but lots of people don't do that, you didn't say so in your first post and we're not mind readers. When you ask for advice on a forum, what you get out of it depends on what you put into it.
You don't seem to see the fact that you have "real" arrears as a problem. I'm not sure how you wouldn't think they confuse the issue.
If you're not prepared to take those points on board then don't worry, I for one won't bother again. I suspect I've dealt with more debt problems than you have, and I know several of the other people who you've effectively just told to get lost have done so too, but hey I'm sure you know better than all of us - that's why you asked for help right? If you don't stand for something, you'll fall for anything0 -
As others have said, it really is in your best interest to pay the two months arrears asap.
In terms of contacting Welcome in writing, the branches have a habit of losing everything, recorded or not. Send a copy of anything sent to the branch to the following address:
