forms, car & reasons for BR questions

Hi, I have a date for BR set for 31st March. Currently filling in the forms but have the following questions:-

1) Assets - Car, filled in details in 3.7 but it says I have to include in 3.1 as well but I am unsure under which heading. The only place I could put it is in Tools of trade. I am currently unemployed and seeking any kind of work but if I secure work as a ceiling fixer I would need this car to get to the work place.

2) I realise being unemployed they are unlikely to let me keep the car (although only worth about £1k) but I would not be able to replace it so it would severely reduce my chances of finding work as a ceiling fixer having no transport.

3) Please could someone let me know if my wording is ok for Reasons for BR as follows:-

"After being made redundant in 2004 I moved to a private rented 1 bed flat in Newbury to work for a contractor to learn suspended ceiling fixing on a self employed basis. I was on a low wage but was promised that they would fund qualifications by onsite and college training and that after a couple of years my daily rate would increase significantly. My daily rate did increase slightly but never to the level as was promised. I started to struggle ffinancially but I stayed loyal to this contractor because I needed the funding for qualifications but that did not happen either and eventually in October 2008 the work dried up anyway. During this period my living expenses outweighed my income and unfortunately I used my credit cards to make ends meet. I then moved back to my home town for family support. Since then through periods of unemployment until May 2009 my parents assisted me to pay my monthly obligations to creditors. I then contacted CCCS who advised me to pay £1 monthly token payments to each of my creditors until my review in July 2009. At that point I had secured a job in full time employment so I embarked on a DMP with CCCS. However as of 31/10/09 I became unemployed again so they reduced my DMP to £25 per month and have advised that bankruptcy is my best option. I wanted to be responsible and pay my creditors but I am very stressed now with the harrassment and worry of it all. I am currently receiving income based JSA but am actively seeking work of any kind"

  • Can only answer the first bit, I'm afraid (and only because I have the form right in front of me!).

    Your car goes under 'Motor Vehicles' under section 3.1 (sub-numbered 14) about halfway down on the second pg of section 3.1, as well as in 3.7.

    Hopefully someone more experienced can help with your other queries.

    This is very weird but this subsection under 3.1 does not appear on the online forms?

    These are the sections of 3.1 in the online form ..

    Cash in bank, building society or similar account
     
    Money owed to you
     
    Tools of your trade
     
    Stock in trade
     
    Machinery, plant and equipment
     
    Fixtures and fittings
     
    Freehold or leasehold property
     
    Stocks, shares and other investments
     
    Farming stock and crops
     
    National Savings and Premium Bonds
     
    Any property abroad in which you have an interest, including timeshares
     
    Any property or sums due to you under a will or trust

    Any other property of any value, e.g. paintings, furniture or jewellery

    I was told the car has to be listed in step 3.1 .. which section here does it go under ?

    [FONT=Verdana, Arial, Helvetica]"In the online form - State of Affairs 6.28 (NOT the paper or print off form), you are asked to give details of any motor vehicles owned in section 3.7. It also states that you must include any such vehicle in 3.1 - the list of assets. But there is no specific category for motor vehicles in 3.1 in the online version of the form.

    The Insolvency Service online forms helpine (0845 602 9848 - very nice people)told me this morning to list the vehicle as 'any other property owned'.

    Hope this is of use to someone, sometime."
