Financial Hardship

I am currently on extended leave from my job, my intention was to pay of all the debts I had before going traveling. this was all before the economic downturn. It turned out my former bank made a bit of an error with the loan I had with them and effectively gave me more money than what was requested. I did not know about this at the time the loan was taken out as I was taken into hospital very shortly afterward to have a major operation to replace a prosthesis that is embedded into my body. By the time I was fit to see my bank statements they had swept a lot of the money into a surplus account which I did not receive regular statements for. I had to return back to the UK due to more ongoing problems with my prosthesis which I couldn't get assistance with abroad. I was legally working abroad due to the types of Visas I had.

Now they have set up an interest free loan for the extra amount, repaying it at 80.81 a month, this was set up whilst I was unpaid leave and they had full knowledge that I was not in employment at the time. I have requested to go back to my old job, but have yet to hear back from them, I am not due to go back until February next year. I have applied for a number of posts but I keep getting responses that I am either over qualified or I don't have enough experience. This complaint is with the FOS at the moment, but soon I really am not going to be able to afford the repayments. If I go down the line of financial hardship would this effect my credit rating?

    Any non payment of your credit agreements regardless of your circumstances is going to have an impact on your credit rating, yes.

    But say if I claim on financial hardship and ask them to reduce the monthly payments will this go against me?

    I have indicated that I was made to sign the agreement under duress, which I was, it was either sign or they would take me to court even though I made it clear that I would not be able to afford what they were demanding.

    Could this be something that could be re-negotiated?
