Problems with Mackensie Hall for previous tennants debt

Hi I am really new to this, please excuse me if I jumble things up a little.

I moved into my council house 6 years ago and I lived here ever since, shortly after moving in I was getting lots of mail for the previous tennent who did a bunk on a debt.
They never left a forwarding address but they moved to a new place with the same council.
I didnt open the post but sent it on to the councils head office as my housing officer told me too.
Eventually they told me to stop sending it and just bin it. Which I have been doing ever since.

A few months ago I started getting letters addressed to "the tennant" form debt collection agencies who were trying to collect on a debt for th old tennant.
I got in touch with them and told them I have taken over the tennacy and the debtor had moved, since then they asked for proof which I provided. They then sold the debt on about 10 times and I have done the same with all the other companies.

Mackenzie Hall however are being awful to me, they send voice txts to my house at all hours of the day from 6am to 9pm, they refuse to talk to me on the phone because I am not the debtor, they refuse to believe the debtor has moved on, they refuse to leave me alone and are now sending letters addressed to "the tennant" saying they are going to come take my possesions away.

I dont know what to do about it, they are so rude and obstructive and downright abusive at times.

My personal nurse has even written to them saying its affecting my health as I have mental health problems and I also struggle with language and comprehension as I have an accuired brain injury.
Mackenzie Hall ignored it and stepped up the phonecalls.

  • I'm so sorry that you're having problems with them too.
    I had dealings with them after they wrote to my husband stating he owed money on a debt from 8 years ago. They refused to provide any proof, and were incredibly rude, obnoxious and unprofessional. After several phonecalls,letters etc, I emailed them asking them to send proof. They admitted that they couldn't provide any documents and closed their account.
    (Mackenzie Hall buy lots of debts and as far as I can see, try to intimidate people into paying money which they propbably don't owe in the first place.

    Maybe send another letter by recorded delivery so you have proof that they've received it. Have a look at the office of fair trading website, type Mackenzie Hall into the search field.

  • Creditors and debt collectors are not allowed to send letters addressed to "the tenant". I would advise you contact Trading Standards and/or OFT - maybe you should inform Mackenzie Hall that you will be informing TS

  • :beer: thank you all so much, I was so stuck with this whole thing I was so worried I would end up stuck with this going on and on!

    If they keep calling me do I say anything to them?
  • Im sorry I forgot to add that the my telephone number that they have been contacting me on is registered in my name, it moved with me form my old address that I lived at 2 years prior to moving.
    Its in my name, its always been in my name and I don't understand how they have got hold of it and if they are allowed to use it when its only in my name and not the debtors??
    Is there anyone I can complain to about that?

    The way they got your phone number will probably be :

    They have your address from the old tenant.
    They look the address up on the elctoral register and find your name.
    They look your name up in the phone directory.

    If you follow the advice above, the phone calls should stop.

    I would send them a very stern complaints letter (recorded delivery so they can't claim they didn't get it) and explain you have reported them to the OFT, FOS, Trading standards etc, etc and that you expect to never hear from them again.
    I would ignore them on the telephone as clearly they don't listen to you and will use the opportunity to try and frighten/bully you and talk a load of rubbish. :mad::mad:

    Fatbelly is bang on. Follow my template letter. No need to get recorded delivery, just get proof of postage from the Post Office (free). The Financial Ombudsman Service will assume it was received two working days later and the clock runs from then if sent first class.

    They will also investigate individual complaints free of charge (for you) and will report to the OFT if they see a trend. The OFT is much more likely to take notice of FOS than of you.
