just to update.had my appeal and the appeals manager seemed most interested in the whole debacle of not getting my appeal etc. ,spend about 50% of the appeal on this matter
also asked for me to forward my proof of deliveries on the letters i sent and i guess he will be asking the same of the manager who said they had sent me a letter/called me

the appeal seemed to go as well as i could hope for. i was careful not to come over as a bitter employee and stuck to the facts
i am expecting to know the outcome by the end of next week

just don't post the real ones....they may get lost ;)

Seriously at least you take some photocopys and keep them in case there are any future problems
    Always ask ACAS

    that'll work as well!
    Always ask ACAS
  • just to update
I got a copy of the minutes of the appeal meeting notes
    checked them and returned them
that was about the 26th IIRC
so far i have heard nothing
so I fired in my ET1 application yesterday
Its been about 14 weeks since i got my notice from RM and the end of this month would have been my 3 month deadline
  • still no news from RM

I have received a standard letter from ACAS regarding the ET1 and their conciliation service
however i think we are past that stage now

given the timescales now,I think RM were holding out to try and go past the 3 month deadline for ET applications
so they could just deny my appeal with no follow up available
  • well I finally got my decision
after plenty of smoke and mirrors from RM,I have won my appeal
I got the result in writing on Friday
It stated I would hear from my manager regarding the appeal
so we shall see when and what I hear from them
thanks for all the advice :)
  • and 22 days later i finally have returned to work
