Car Insurance - included in BR?

I went BR on 28th August 2009 and had a car insurance policy that was paid by DD. I thought the policy had been cancelled as no money had been collected for 4 months and we scrapped the car but the insurance co have written saying they didn't collect any money between Nov and March due to a system error and that i owe it to them. I did call them to cancel the policy on 1st march when i got some correspondence from them and realised it hadn't been cancelled!
They said they didn't collect due to a system error and didn't write to me due to a system error too. My query is - as this is technically a credit agreement taken out before BR is it a provable debt and therefore included?
Thanks - if it is it will save me a lot of bother fighting with them!

If it's a debt owed and not a current policy then yes it would be included.Total 'Failed Business' Debt £29,043

Did it come from a bank account included in you BR, ie which was closed later by bank?0

If you have made voluntary payments from your acount then I think you will have to pay them. Luckily not too long. I would still write to them and say as it was a computer error on thier behalf can you make a mutuall agreement.
