i have just had 2 weeks off work due to a unfortunate injury, as a result i got a doctors note and posted it to work (just as they asked me to) then comes payday and i receive about 4% of my wage, they tell me they have not received my sick note so i have been and got another and handed it in. i get full sick pay if i follow the guidelines which they have confirmed i did, now i have 3 direct debit charges. Does my employer have to pay these?

The first 7 days should have been paid as you can self certificate for this time but the second 7 days it is your responsibility to make sure that work have the sick note...you may have posted it but it may not have got there (or they could be lying but only you would have a guess ifthat is true)

So IMO its 50/50, if they have paid you for the self certification period then no its not their responsibility if they have not paid you for any of it then I would expect them to pay 1/2 of the fees (however there is no harm in asking for all of them to be repaid...they can only say no.)

  • they only paid me for 1 days overtime i did the previous month. i offered to drop the sick note off asap which was 3 days after i got it due to me not being able to drive because of the injury so the manager said "post it to me". i have a letter saying that they have suspended all payments inclusive of ssp until i get them the sick note in.

whats happened to the other two weeks in the month thens pay?

  • the letter says they "have stopped payment of your (my) march salary" and i need to send my doctors note to the manager to get it reinstated. i have just moved into a new house and used every penny i have to do this so i cant pay my car insurance so iv had to have the last week off work unpaid too.

they cannot stop payment for the time you were actually at work, this would come under unlawful deductions of wages, however as said in the first post they can withhold wages if you cannot prove they have your dr's note for the second week of your illness

  • if they would have paid me ssp that would have covered my direct debits. but my sick note states i was off the first 2 weeks in march, but shouldnt they have at least paid me 1 week self cert ssp?

    You're not making sense,

How often do you get paid? Weekly, fortnightly, monthly?
If monthly which is what I presumed did u work 2 weeks and then been of sick two weeks?

    thanks

  • i get paid the 15th of every month (2 week behind 2 in front) and i did this on the 27th of February so was not able to work the 28th or for my 2 week period after that.up to the 11th (i do 4 long days a week).

If they only pay SSP then the first 3 days don't tend to be paid.

I think you need to work out what you actually expect money wise before asking them so work out how many days you have actually worked since last pay day and how many days you have been off sick and go from there.

It seems they have short changed you a bit but how much you'll have to work out

  • i do get full sick pay, but st the very least i should get ssp. ill work out what im owed and if it would have covered my direct debits.
