Bankrupt

We found out yesterday that an aquaintance owes in the region of £40k.There is no way that this person can pay this back as she has had a bad accident and will never work again.

The problem is that she cannot afford to raise the money to give to the courts to allow her to go bankrupt. Is there a way of doing this for nothing?

Also, please could someone point me in the right direction to the thread that tells what bank accounts are available after bankruptcy. Thanks

I think one of her creditors can make her bankrupt, although tbh im not sure how this works out

She could just get out another loan to pay it :S

I'm pretty sure you still have to pay for it. I can remember a post on here by someone saying 'if they had the money they needed to bankrupt, then they wouldn't need to'. Its mad isn't it.

The fee is currently £475, this breaks down into -

£160 for hearing (if she is claiming certain benefits she can fill in an EX160 form from the court to waiver this)
£315 for the bankruptcy fee, this can not be wavered however this amount will be refunded if bankruptcy isn't granted.

She could apply to an energy trust (if she is supplied by a company that has the trust) or a social fund for the fee.

They could wait years for the creditors to take them to court and very few would as they want the money.
Taking a loan out for bankruptsy isn't allowed but people still do it.
As for bank accounts most do a basic bank account, it is deemed impossible to function without one now so tell her not to worry. I like the Natwest step account.

You will need to find out who supplies her gas & elec and then just google them i.e. British Gas energy trust, if her supplier have a trust you will be able to find it that way :)
