Are IPA repayment breaks repaid?

My partners IPA ended in January. During the 3 years the agreement was amended 4 times and he had quite a few agreed payment breaks for various reasons (new washing machine etc etc)

At the time he was told these breaks would not be added on and on the new agreements this appears to be the case.

Well yesterday after talking to moonbeaver the OR have now said that all the breaks need to be paid back. Is this right? I have found posts on the internet where other people have also been told the breaks will not be added.

Also last september he sent a new expenditure sheet due to a pay rise. It took 4 months for the OR to reply but they never sent out a new agreement (just told him the amount over the phone). They are now saying they want further payments of this new figure but will not send out a new agreement. Is this even legal? Please help!!

    As far as I am aware, the IPA consists of 36 payments, even if there are breaks there still needs to be 36 payments, so yes he will have to pay the payments he has missed. If I am wrong one of the more knowledgable forumites will be able to correct me.

    I'm sorry to confuse things - and I may be wrong...

    But I thought any suspended IPA's counted towards the 36.

    In other words an IPA is for 36 months not necessarily 36 payments.

    You are correct if the IPA was suspended, then it would continue for the total remaining of the 36 months at zero, unless the BR's financial position improved, then it would be re-assesed, and a payment resume for the remainder of the 36 months, whatever that may be after the re-assesmant.

    However, this does not apply here as it was not suspended, just the OP was given a 'break' (unless the OP has anything in writing that states it was suspended), so they have every right to ask for the paymants to be made up, as per the agreemant.



    However, if they failed to adjust an IPA after you told them of a change, in a timely manner, then tough, thats there fault.
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    unless your IPA changes for loss of earnings or wage drop you will have to pay 36. if you take a break for whatever reason apart from less earnings you will pay till end of 36 complete monhs.
