Tribunals and appeals

Hi

Hopefully somebody on here can put my mind at rest ...

I am the NRP and my ex took me to a First Tier Tribunal hearing which was found in my favour. She then appealed to the First Tribunal which turned down her appeal but said that she could write direct to the Upper Tribunal for another hearing. This she was done and I am now waiting to see what comes out of that.

I have read that she can only appeal against a point of law. Based on this, can I take it that unless she has found that whatever law was not followed at the First Tribunal the Upper will just throw this appeal out? Am I missing something this has dragged on for a couple of years and it would be good to draw a line on this.

Any help please on this gratefully received!

LJ

might be worth putting a written complaint in and getting on to your MP.

    other than that, pass!!

LittleJohn, I believe you are right, this can only be pursued it an error was made or decision made which is incorrect on a point of law. But as is our experience it doesn't stop the bitter PWC trying!!

    Thanks bdt1,

My ex is not happy with me... I think it is unlikely that she has found any inconsistencies in the first Tribunal..., and as you say it's just a try-on.
