Help with lloyds CCA

Hi Everyone

This is my first time posting, so please bear with me.:)

I have a mastercard credit agreement going back to 98, which i have recently sent a cca for.

I have been making token payments to them for quite a few years. And i finally plucked up the courage to deal with them.

I have gone through the enforcablity checker and i believe that it is enforcable. As all the prescribed terms are in the terms and conditions which are attached to the agreement and it refers to the conditions on the signature page.

My query on the agreement is that it is not filled out by myself and their are a lot of incorrect details, namely the time at my address is incorrect, it states that i was employed and i was doing a training for work at the time and went to college one day a week and then had a placement. So the placement is on the form with the incorrect address and that i was employed by them.

They have also said that i was having a weekly salary. I was on income support and this was not a guarenteed income.

I had a bank account with lloyds at the time and i had never gone overdrawn or had any credit before this.

I wondered if i could do anything about this?

Back in January i sent a SAR to them and they acknowledged this and cashed the cheque but i have still yet to hear from them and might have to contact the ICO as i want to see if they have any more information of this form.

If someone could comment i would appreciate it

    Hi post up here, sure you'll get help. I also had a Lloyds CCA from 98 which was deemed enforceable as all the prescribed terms were there however they had ticked PPI so worth checking for that.

    Thank you for the reply. I have checked the ppi and no they haven't ticked the box.

    Back last july they offered a full and final on £3,500 at £916.00 That was before the CCa request. I didn't have the money at the time. I have offered a full and final settlement now at £1000. And they are refusing to take it £2,500 is lowest they are saying they will go. A member of my family has offered this money to me.
    I am still on benefits still have a range of mental health issues, so a letter from my doctor was sent to them as well giving my medical history and even with this they still have refused. I just want all this gone. They have AIC dealing with the debt. So i think that commision is involved here as well.
    I am trying. Other wise it means that they go back to getting £1 a month which is what i have been paying since 2004.

    It is all really getting on top of me. But i know i'm not the only one.

    The other option of course, would be to do what Big Craig advised and post over here and you'll be able to get answers to what you seek: Unenforceability & Template Letters III

    If you want to pay £2500 on a £3500 debt then please come speak to me - i'll be quids in! The most you would offer on a £3.5k debt is £700 (1/5th)
