Can a creditor refuse a Debt Management Plan

Hi everyone.
I have been struggling with my debts for far too long, & I have been paying some of my creditors myself £5 a month to keep them off my back. However, one creditor will not accept any of my offers & are demanding I pay £50 a month to them which is just not affordable to me. I have done everything they have asked, sent bank statements etc but they have now threatened a CCJ, which although they have advised via email one has been placed I have not received anything in the post. I have advised them a few times that I have not received the CCJ in the post & yet they never answer me.
Anyway, I have now entered onto a debt management plan with a company called Payplan. At the end of the month I will make my first payment to them. This same company who refuse to compromise have now emailed me to advise that they will not accept a debt management program as explained in my agreement with them.
I have no idea if they can point blank refuse to accept any payments from Payplan, does anyone else know if this can be true?
Please help, loosing sleep over it!
Thanks in advance.

well unfortunatly the answer is yes they can refuse a DMP because it is basicaly an informal agreement, however do not fret
a CCJ is not the end of the world, basically all it is is a payment plan enforced by the courts,
a judge will not make you pay any more than you can afford, since you have been making the payments you can afford and are now going with a reconised Debt management charity you have shown that you are fully willing to pay the money back - and in most case's the judge will just set the payment exactly as payplan have!Drop a brand challenge
on a £100 shop you might on average get 70 items save
10p per product = £7 a week ~ £28 a month
20p per product = £14 a week ~ £56 a month
30p per product = £21 a week ~ £84 a month (or in other words one weeks shoping at the new price)0 -
Hi
Yes they can. A DMP in only informal. Even if they refuse your offer, you must still make payment to them (through Payplan) at the level you have offered.
If they took court action to obtain a ccj you would receive court papers in the post (before a CCJ could be granted). If you do come on here for advice, do not send them to your DMP provider.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
OK, So as I understand it I should provide my DMP company the details of this company so they can contact them & make arrangements for payment? Or do I just keep trying myself to come to an agreement for payment? At the moment they are not excepting anything lower than £50 which I cannot pay so I am not even paying them anything currently. Obviously I am willing to pay though £5 a month.
Thanks guys0 -
Yes. You will give Payplan all your creditors and they will make the payments agreed between you and Payplan regardless of whether the creditor agrees to the level of repayment or not.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0

All done. Payplan now have all the details they need. Hopefully now I can sleep easier.
Thanks for advice.
