WHat Next?!!?

Well i havnt been on the site for a while as i have been working a lot! (woohoo got a job!) and my problems are getting worse!

I made a call to my bank Natwest about a general query and ended up on the phone to someone asking really personal questions (can your dad give u any more money? what work experience do you have? etc etc) for 40 mins!

I am currently £74 over my overdraft and on my other account £66 overdrawn due to charges. Every week i got paid £30 EMA into my o/draft account which was taken back in charges, and last week had my final payment of £100 bonus (for being good and attendance and stuff ) paid in to which has been taken again!) back to my original story of the phone conversation...

The man i spoke to said he had started legal proceedings against me which would take 28 days to close my account and pass it over to a debt company unless i paid in the overdrawn amounts + £125 charges and a further £125 charges on the 31st august! As i was telling him i didnt have a job this would not be possible (he wud not listen!)

Just wondering where i stand with this?

I am in the process of trying to get the charges refunded from the past year which amount to about £1500 but ordered and paid for the statements about 6 weeks ago and have still not arrived.!!!

Someone please console me here i dont know where to go next!!!

    Tell them that if they issue court proceedings you will issue a defence and counterclaim for the charges. They are however unlikely in reality to issue a court claim - sounds like they have acknowledged that in fact they will be sending the account to a debt collector. Do not accept any liablity for the charges element and threaten (and if necessary start proceedings in the small claims court) to get the charges refunded. Complain and press for the statements - they have to send them if you have paid for them. If the account ends up at a debt collectors refuse to deal with them until the statements are sent to you.

    If you are getting EMA then you must be under 18 and therefore a miner. Dont know if they can take a miner to court? Hope someone can help.

    Miners can be over 18. Minors, however, can't be.
    I used to think that good grammar is important, but now I know that good wine is importanter.

    I am actually 19 so will no longer receive ema, it was my last year of getting it!

    I have only received my statements today! woohoo!
    is it possible that the bank can hold charges off the statements as there seem to be a lot less than i thought i have paid! Also what is the 2nd letter i send to Capital One if they have replied with the standard letter of the charges are fair etc!?!?

    I dont think so - the statements are supposed to be a true statement of your account - Perhaps this is wishful thinking on your part LOL are you registered on https://www.consumeractiongroup.co.uk ? you will find all information on how to make your claim under the FAQ's there and templates for all the letters - good luck :)

    When did they start to charge you? if you were under 18 i think they are on dodgy ground....did you have a student account?

    Also, where are your wages for your job going - into the Natwest black hole?

    Hiya, no they are going into a barclays savings account whilst i open a new current account (if i can get one!)

    Well according to my statements i have received they only started charging me in feb this year but there is no chance because from august 05 to novemeber 05 i didnt have a job! And i had bills to pay which started me going overdrawn!
