    If you get the letter, keep it for at the very least 6 years incase anyone tries to follow it up.
    Hi FATBELLY - what difference would the 'without prejudice.' phrase make please ?

    'Without prejudice' means that the letter cannot be used as evidence in court.

    If someone (another third-party debt collection agency perhaps) tries to take court action on this account, you need to be able to provide written evidence, and as DC says, that evidence needs to be retained for six years.

    Beyond that date the Limitations Act prohibits court action anyway.

    We can confirm that we will accept £5100 in full and final settlement.

    Please note that once payment is cleared on the above account, then the account will be marked as closed and returned to our client, who will amend your credit file accordingly.

    Does this sound ok? I just want to pay this off now!!

  • Could she not chance it and ask for the default to be removed as well?

    I'm new, and no expert. This is just a thought. However if you have other defaults then there would be little point to that.

    Thanks. I think I'm just going to go for it. It does state full and final settlement, and it does NOT say without prejudice. That's all in my favour.
