Hi All,
Needing a little bit of advice on this please.
I have offered a full and final settlement to Barclays.
They have sent me a letter with the following.
We write with reference to your recent communication and your telephone call with XXX
We are prepared to accept the amount of £XXX as a lump sum payment and not pursue you further for the debt, provided that the payment is made by 16th March 2010.
I have read of the form that I you should only pay them when the letter states this to be full and final settlement. So I rang them yesterday to tell them this and they say that this is a generated letter and that they couldn’t change it but that they would accept this as full and final and neither them or any 3rd party would come for the reminder of the debt. I was wondering what everyone else thought about this? Thing is even tho it states in the letter that this should be paid 16th march they said that I can pay later as I am waiting for the funds to clear. But if I do take there word on this letter I’m also worried that as I am paying after the date on this letter and it would show on there records that I have paid later, and that the could use that against me saying that cos I paid after the date on the letter then I wasn’t a full and final.
Any help would be great.

I wouldn't Gem.
I think as you say the 2 things combined could mean they just carry on chasing the rest.
I'd insist on it saying F&F and a new date being generated. I'm sure other people have got the right wording out of them. Maybe you'll need to write again rather than go by phone re-iterating that the letter from them must say F&F and that they must give you a week from your receiving the letter for you to pay.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
