Putting a Note of explanation about a debt on my credit file

Hi guys

Following on from the great advice I've had about whether or not to start 'Set Aside' proceedings over an unfair CCJ I got in 2008 for £300 - I'm just wondering (as it's highly unlikely the CCJ would be set aside due to the length of time passed between then and now, and also being unable to prove that I was unwell at the time)

But - could I put a note of explanation about it on my credit file? Could I say something like "Unsettled out of principal" or "unsettled as wrongly received - did not realise we could dispute it until too late" ?

I'm probably being totally deluded here :p but worth a shot I thought as paying it just ain't an option :cool:

Any advice greatly appreciated :)

    You could put a notice - but in truth I don't think either of those wordings would help. Any lender would be very cautious about what you meant and could steer well clear.

    They would assume if you dispute that you owe the debt you would apply to have it setaside or if not that you should pay up. Sorry.

    Is your reluctance to apply to have it setaside because of the cost compared to the CCJ amount or because you might not qualify to have it setaside?

    Thanks Tixy - that's exactly what I thought as well! Worth a try though :)

    The reluctance is because I probably won't qualify. It's been 2 years, I effectively admitted it at the time by signing the papers and sending them back when I should have sought legal advice as we definitely had a case. But, I had just given birth and was suffering depression because of our scary financial situation at the time. I don't have any evidence from the Dr that I was depressed because I didn't (couldn't) go - I just battled on.....I'll put the violins away now!

    I could attempt to get it set aside, but it could open a whole big can of worms now as it all went quiet after the CCJ was set.

    I'm more up for just letting it slip off my credit file in 4 years time but there's this niggling worry at the back of my mind that this creep who served it to us would actually try and reinstate it in 2014.

    Well is he chasing you for the CCJ at the moment? done anything? instructed solicitors? if you've moved are you on the electoral roll?

    Its unlikey he'll get permission to reinstate it.

    No he's not chasing me at all. He's done nothing. Yes we have moved but it was over a year ago and we went straight on the electoral roll. It has never crossed my mind to contact him with my new address but I know that if he wanted to find me he could easily. Plus, I was getting forwarded mail from my old address and I spoke to the court very recently to get the N244 forms emailed to me and they never mentioned anything.
