Just had a phone call from the county court

Hello everyone

First post on the board but been looking at it for several weeks now and find the advice from everyone fantastic and so helpful.

Me and my husband are due to go bankrupt on the 24th March after waiting 5 weeks for the date to come and counting down the days.

But this afternoon had a call from a lady at the court saying that there was strike action planned for that day now and she would phone us back on the 23rd if it wasn't going ahead.

As you can imagine we are totally gutted and can't believe it!!

We are just wondering if we cannot get a new date until after 6th April does that mean we would have to pay the new fees even though it's not our fault?

technically if you petition before but the order is granted after the change you would pay the cheaper fees. Most debtors petitions petition on the same day as it is granted but it may be worth asking the court if you can take the fees and paperwork in this week to petition even if the hearing is after. dont know if they will let you but you dont get if you dont ask
Hi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.
  • I agree debtinfo, strictly speaking they should not have warned anyone of the action, but they did, so they may try help that way too if you ask;)

    Evening.

Sorry to hear you have had your appointment rearranged due to the industrial action due to take place next week.

It is correct that you will have to pay the increased fee after the 6th April and the Insolvency Service have made it clear that there will be no leeway on this.

Obviously this doesnt help you so you need an appointment before the 6th. I would advise phoning the court tomorrow and speaking to the section manager or the divisional manager depending on the size of the court and they should be able to accomodate you (although you and your husband may have to go on different days). We have as a temp measure increased the number of appointments we are taking so that everyone can be accomodated before the 6th if they want to.

You may need to be persistant but you can technically turn up at court at any time to present a petition - the appointments system is for convienience rather than necessity

Thats true too, if you look at the bottom of I think the second page of form 6.27, there is an endorsement for petitions that are presented but not heard immediately. This way they are checked, the fees taken and you come back at a specified time and date for the hearing and making of the order.

Most courts dont use this system any more, but the endorsement is on the forms so can still be used xx

Thankyou so much for that info....will def ring court tomorrow to see if we can petition this week. In the meantime it'll just mean putting up with extra creditor hassle!!! Will keep you updated with what happens.
