Sounds like the garage is fobbing her off to a degree - they should have done an HPI check before selling the car on. Admittedly, this isn't the law but it's certainly good practice on the part of the garage. Definitely CAB for the immediate problem and then Trading Standards to report the garage. The information is a bit sketchy but if the car was bought from a dealer who did not settle the previous HP- then the dealer is fully liable for settlement and the Finance company should chase him.
Your friend is regarded as an innocent purchaser under cca regulations.
If the car has now got current HP in your friends name then the original Finance company could also claim the settlement from the new finance co under section 56 of the cca act. So if this is the case Close Motor Finance should approach the dealer and/or current Finance co for their settlement.0
