Ive had the day from hell , before i start please dont think that im in any way a compulsive liar , today sounds really far fetched !!! its gonne be long sorry ..
so i come home to find a letter from billy bailiff for th esome of 1222.86 for outstanding council tax,
now i was expecting the bailiff and had been setting aside money , i knew the outstanding debt to be 736.00 so i was a little shocked to see all the charges, i called the bailiff and said yes i have 600 quid of the money im abit unsure off all the charges that have been added so could you please send me a run down of what ive been charged for and then ill continue to pay you at 30.00 a week until cleared,
he was happy with this and even said (yeah thats fine thats more than enough) (YES HE REALLY DID SAY THAT)
anyway i told him to give me half hr to jump in the car pop to the bank so i could withdraw the cash then he could come back and id pay him 600 quid in cash
(okay here it comes) ...... gets to the bank sticks my card in the machine to check balance and the balance is.......0... rubs my eyes.. looks again still 0 get a mini statement , according to the bank yesterday was my last withdrawal of 300 quid..
my cash card had been cloned !! after an half hr in the bank on teh fones to the fraud squad etc etc i send my husband home to tell billy bailiff there was a problem.
anyway the bank kindly gave me a 500 quid over draft (until the fraud squad had sorted my account) gets home to find my husband had let the chuffin bailiff in !!!:mad::mad:
he and my hubby had a verbal agreement ( i know it doesnt stand for crap but he didnt know this)
anyway im left with a letter that has a list of my living room goods saying i have to pay 572.53 in 5 days now my hubby said he'd agreed to pay the rest at 25 quid a week and billy had agreed but nothing is in writing about this?
all i have infront of me is the notice of siezure of goods invetory
liability order court costs council tax 489.03
levy fee 41.00
attendance to levy distress 42.50
total 572.53
where do i stand on the rest ?once ive paid the above can he break in teh day after and take my possesions for the rest nothing is written about the outstanding.

Goddammit, my internet dropped so i lost the reply.
A bailiff can only charge "attendance to levy distress 42.50" for council tax, if you do not let them in.
Now they are in by peaceful entry they can force entry to take goods, so you are now stuck paying them i believe. Herbie can confirm this.
Get in touch with herbie, she has the best advice on bailiffs - http://www.bailiffadviceonline.co.uk/Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Hi
Not sure I can be much help but is there any chance that you owe council tax for 2 different tax years? If so he could be looking to clear the first debt then enforce the second liability order?
Grrr to hubby letting him in.
Double Grrr to card being cloned. Hope you get to the bottom of this bit as well.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
ohhh not sure, but dont think it adds up correctly , anyway this bailiff wants this money within 5 days (thats fine) but what im worried about is the rest can he come back on the 6th day and break in to take my goods, or even demand the rest of the payment on the 6th day , even tho his verball is 25 quid a week after ive paid the 572.53?
also , my hubby let him in and signed the siezure of goods, is that legal if in my name only?
thanks for your answers xxx0 -
My first reply was terrible i was 1/2 asleep. The website given though is the best place for information on bailiffs regardless, i can't suggest better than that. Its 60p a min to ring but herbie is the only real place for decent advice.
The bill for £572.53 might be a first payment, not the full amount of the bill. No one can tell you without seeing the paperwork it what the figure means, a figure is just data not information.
What you should have to pay is
£xxx Council Tax Owed
£42.50 bailiffs first charges
£xxx Charges for the levy
If you do not pay, then they can charge van hire fees and further attendance fees for removal of goods. If they have a levy (as they have been inside) the goods are legally there's which is why they can force entry if they come to pick them up. Ex-Bailiff on here had a resident assault him when he took goods as the CAB told the resident they didn't have to let the bailiff in (which was only true if there was no levy made).Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

I work in council tax recovery and I would query it with the council if there's any doubt about the amounts issued to the bailiff. The council should be able to confirm the council tax balance and how much the current bailiff fees are (which bailiff company is it ?)I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
