Hi everyone, god my head is spinning lol! i checked my creditfile and have 3 defaults :-(, two from egg issued in 2006..i was never late on payments but they said they had to issue them due to me about to enter into a dmp.
Anyway i was issued one from lloydstsb in june 2009, i had no idea as had not recieved a letter and it wasnt untill i noticed on my dmp that payments had stopped that i looked into it. I rang lloyds but they said the debt had been sold on and wouldnt discuss it anyfuther so that was that untill just after xmas when i got a lovely letter from debt managers ltd saying pay now or else.
So basically im trying to get to grips with things, i see people mentioning cca requests alot should i look into this? Im trying to do some full and final settlements with two debts..the lloyds one above and a egg one with Cabot.
Thanks for all your help

Hi
If you are on a DMP you will almost certainly get defaults (as you have broken the terms of the original agreement bu paying less than the minimum).
However they do have to write to you with a default notice before it can be registered.
Here is a letter to ask for proof that a default notice was sent - http://forums.moneysavingexpert.com/showpost.html?p=30356401&postcount=26
If you want to look at the CCA to consider the unenforceability route you might want to request the CCA and a copy of the default notice at the same time, in which case you would use this letter - http://forums.moneysavingexpert.com/showpost.html?p=30356045&postcount=11
You can only request a CCA for certain types of debt, what was the lloydstsb debt for originally?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
