What could possibly be in it for them?
The number of ET cases where costs are awarded against the claimant is well under 10%. Even if they are awarded they are capped at (from memory) around £8000.
Or do you mean that if you pay such a firm to "do" all of your HR work they, in effect, provide insurance against your costs at an ET. This I could more easily believe but presumably they must charge quite a premium and won't take on a new case if a claim is in prospect?
Also, from the employers point of view, there is no incentive for such a firm to put much effort in on the employers behalf. If they lose the case then the employer still has to pay the award to the ex employee. If they win, as said above the chances of them recovering any costs are slim.
What I meant was and I think you are alluding to it is that you can pay a company for advice on procedures etc and I would say yes pay them a yearly fee for this pleasure but when it comes to doing the procedures correct if you follow what they ask then they will pay any costs for defending a tribunal.
This is ideal for a medium to large size company that hasn't got the resources for a fully fledged HR department but large enough that queries about its employees are fairly regular and who want to get it right.Always ask ACAS0 -
Too right this will offend - which is no doubt exactly what you intended.
If somebody is off sick long term it is because, at the very least, their GP judges them too ill to work. Unlike you he / she will have had many years of medical training and will have had the advantage of seeing the patient rather than jumping to prejudiced and ignorant conclusions on an internet forum.
Stress in the workplace is a major issue which needs seriously addressing at a national level. It is also worth remembering that suicide is the single biggest cause of death in younger people.
The fact that one person may be able to cope in a particular situation doesn't in any way mean another can. In just the same way you may get an appendicitis and others in you office (if anybody employs you) won't.
It is also possible that if somebody is performing poorly in their job it may be due to inadequate training rather than their lack of ability.
Im sorry but i dont believe someone should take 6 months off work after a small amount of time there and believe they would be entitled to come back and everything be normal.
As a hard worker myself i can see how annoying it would be ahving some one leave for half a year... then come back. It affects workload and everything. Im not dispuate the legalities... she may well or may well not have a case....
But long term that job and that style of job probably isnt for her, and taking 6 months to decide that wasnt realistic. It sounds like she only went back after discovering she was pregnant... as i guess it would help stay there or be entitled to maternity pay? (see the title of thread... sacked while pregnant)... when in fact it should be 'sacked because i couldnt do job, got stressed and left work for 5 months.... obviously employers wont think you are worth much. Its OBVIOUS... regardless of legalities they will make your life hard or find a way to sack you (facebook etc) because you haven't given your best for team... you've leeched their monies from company and would not be a good employer.... thats where they are coming from... afterall they got to run a business and make profit.
And yes it would cause offence but this is what a damn site of people would think about a fellow worker taking 6 months off... coming back pregnant (while off sick) then expecting to be kept on books for aanother 9 months..... paid Maternity pay for what to happen? for her to realise 'job is not for me'... and leave? What point is that? sure they platyed the system but a good 1.5 years off a job with pay benefits and hardly any real working time wouldnty be good on a reference or CV.
Whereas if you knew job wasnt for you, you'd get down about it... get !!!!ed off but quit and go on jobseekers and seek alternative accomodation. I dont know how you could stay at home or not work for so long.. i'd get bored.0
