On a joint DMP, but possible separation :(

Myself and my husband took out a joint DMP in July 2009 with Chase Saunders. I know these are one of the more expensive ones, and we weren't in that much debt, but he is really bad with money, and it was the only way I knew to get him to stick to a plan and not get further into debt. And they have been very helpful and the calls and letters stopped a couple of months ago.

Unfortunately things have gone from bad to worse in our relationship and it looks like separation may be on the cards. :(

My question is - what happens to the DMP in this situation? We are currently paying £190 per month to CS, and this is broken down as follows:

My debts:
14.75
59.67
28.41

His debts:
29.49
14.18

Joint debts:
10

All of these were credit cards (apart from the joint overdraft), and they were all taken out during our marriage, and even though they were single accounts, we had cards for each others accounts and they were jointly used.

Bit of other info if thats needed. We have 2 small children and they will stay with me. We live in a housing association house, but the tenancy is only in my name. He works fulltime (salary £15.5k). I work parttime (salary £15k) and we currently pay just over £800 a month for childcare whilst I work. I have one other debt which is a car loan of £114.26 a month until December 2011.

I need to know what will happen with the DMP if we do split? Will it be split down the middle, so £95 each? Or are we both liable for the full amount, so if one doesn't pay, the other has to? Or will it be split completely into the debts that were originally in our own names? I've checked through the paperwork and can't see anything about this situation.

It does look imminent, so I need to start working out my finances now with having children and a house to look after. :(

Thanks in advance for any help you can give me.

Afraid I don't know. You could try calling CCCS or Payplan for advice or post on the sticky thread for ask a CCCS counsellor a question?
