HELP business Van tax penalty

hi everyone
im not sure what is going on at the moment but it feels like we are getting hit for everything ! anyway here goes ...
my partner didnt get his road tax renewel for his business van (it was when the postal strikes were on ) and almost forgot to tax his van but last minuite realised the dvla had not sent the paper work through and so he went on a mission to find his log book , which he couldnt find ! (this was the day before it ran out ) he phoned dvla whom told him he would have to go to the nearest city to get all the paperwork etc, so he set off on the day it had run out in a freinds vehicle to get it sorted , hed got the paper work and couldnt get to the post office untill the next day ... so total was 2 days out of tax (but not driven) .
a few months later out of the blue he got a court letter for unpaid road tax (they had a records of it not being taxed for the 2 tays) and fine would be £900 but he appealed against it and eventually dvla have now said they will reduce to (£360 i think ) if he pays within this month.
its frustrating and feels unfair because he tried to get it sorted and he doesnt earn alot from his business as a gardener , but i wondered why looking on here most people have £80 penalty fines. Is it because it his business van ? tried to look into on internet and cant find anything. just wondered what your thoughts were.

    Why does it feel unfair ? It`s all his own fault , its not the DVLA`s fault that he doesnt earn much money, or that he couldnt find his log book....
    Also , it makes no difference at all that it wasnt driven when it was untaxed.

    Cant help on the level of the fine though , could it be your oh FORGOT to pay the £80 he was charged in the first place ?

    No , not a bad day , just another person moaning about the rules that everyone else has to live by

    Can't offer any advice but I do feel for you, I am pretty certain if I didn't get any reminder I wouldn't remember to tax my car, in fact I taxed mine a date late this month anyway (hoping I don't get a fine).

  • OMG I didn't know you could get fined for being a day or two late taxing a car/van that is not actually being used. Need to catch with the times!:eek:

    But DGJsaver is correct, some people dont want to take responsibility for their own actions anymore. we have all had parking tickets, library fines, bank charges etc etc but sometimes you have to hold your hands up and say its a fair cop sorry my mistake.

    I agree £360 is a lot of money and I do feel sorry for your partner, it may be higher for a commercial vehicle??

    ok so i was having a moan ... life does feel unfair sometimes doesnt it ?
    anway i do believe u are right , i supposed i am frustrated because i am an organised person and my partner isnt ! it seems to be just the way he was born ! no matter how much i get on his case.
    Anway i suppose what im wanting to know is do you think he should have first had an £80 fine ? (although he had not mentioned this as he thought the court letter was out of the blue). or do business vehicles get higher penaltys ?
    if he did not recieve the first letter if was a £80 fine originally how can he prove he never recieved it ?

    You should have an organiser in your email. Put it to use with the date of when it's due and maybe a note of when you should start looking for it at an earlier date so you can stay on top of it. If you use outlook, you will get a reminder when you log on.

    thanks yes i totally agree ... we are grown adults and should no the rules by now ( or he should ! )
    maybe it is because its a commercial vehicle, will try and look into a bit more

    good idea , im the opposite to my partner and do make notes on everything due but i think im just going to have to start organising him too !
